‘Choice for Me, But Not for Thee’? NHDems Oppose EFAs, Send Kids to Elite Private Schools

State Sen. Tom Sherman is running for governor as a self-declared champion of public schools and opponent of school choice. He opposes allowing low-income families to use public money to choose a private school education for their children.

Perhaps the same private school Sherman chooses for his son.

While Sherman says he is a proponent of public school education, he sent his son to the Governor’s Academy in Newbury, Mass., a private school with tuition approaching $70,000 per year, GOP activist Patrick Hynes reported in his Union-Leader column on Sunday.

“The Shermans are a family of considerable financial means and are free to send their kids to whatever schools they want. EFA supporters are merely asking for low- and middle-income families who aren’t as wealthy as the Shermans to be able to do the same,” Hynes wrote.

Sherman doesn’t agree. He voted against the Education Freedom Account law passed by the legislature and signed by Gov. Chris Sununu. It allows low and middle-income families to use their child’s share of state funding  — not local money–  to choose an alternative to their local public school. That could be a private school, a parochial school, homeschooling, or a public school outside their district.

“My first choice would be to stop the program,” Sherman said of the EFA system at a recent debate with Republican Sununu. Sherman has also proposed an annual means test so that if a family’s income one year exceeds the current limit (300 percent of the poverty level), even temporarily, their children would be kicked out of the program.

“Tom Sherman is a school choice hypocrite,” says Corey DeAngelis with the Educational Freedom Institute. “He sent his kid to a private school yet opposes school choice for others. I’m glad his family had that opportunity, but he shouldn’t fight to trap low-income kids in failing government schools.

“Marie Antoinette would be proud of Sen. Sherman, because these school choice hypocrites are essentially saying, ‘Let them eat cake!'” DeAngelis added.

Asked about the allegation of hypocrisy, Sherman declined to respond.

When it comes to opposing EFAs while opting out of public schools, Sherman is hardly alone.

Progressive Rep. Debra Altschiller (D-Stratham) who is currently running for Sherman’s seat in the state Senate, is a staunch opponent of the EFA program, supporting complete repeal.

“Implemented by Republican free staters–and millions of dollars over budget–the school voucher program drains public school funding and threatens an increase in local property taxes,” Altschiller states on her campaign website. But her children have attended elite Phillips Exeter Academy, with $50,000 a year tuition bills, and Berwick Academy, a more affordable $30,000 per year.

Altschiller is also factually incorrect about the EFA program’s impact on local taxes. Because EFA’s only use the state portion of a student’s funding, when students opt out of the local school, the local funding still flows to the classrooms they left behind. As a result, per capita revenue for local schools actually increases when students choose the EFA option.

Sen. Cindy Rosenwald, D-Nashua has also pledged to repeal the EFA program if possible, while sending her son to Groton School, a private boarding school in Massachusetts that currently charges close to $60,000 a year.

Rep. Mel Myler is the ranking Democrat on the House Education Committee and a vocal opponent of parental choice. But when NHJournal contacted him about sending a child to Holderness Academy (boarding tuition: $71,000) Myler declined to comment.

And there’s Rep. Marjorie Porter, D-Hillsborough, who complained this year that advocates wanted to make EFA’s more accessible to New Hampshire families.

“They try to sell them as helping poor kids have choices too, but they have brought several bills forward to raise the income cap to five hundred percent of poverty level, or to eliminate it altogether, making me wonder how a family of four earning $132,000/yr. can be considered poor,” she wrote.

But while speaking out against EFA’s this year, Porter admitted she sent her child to a private school because the public schools weren’t working for her family when he son experienced difficulties.

“I certainly understand the need for families to find an alternative to public schools to meet the needs of their children,” Porter testified. “My own two children attended the same public school where I taught. My daughter was fine with it, but not so my son. He was experiencing difficulties, so we sent him to a local private school until he was middle school age.

“It was good that we had that option,” Porter said.

Not all Democrats believe their position is problematic. “I opposed the EFA vouchers too & I myself actually went to a private school,” Rep. Timothy Horrigan (D-Durham) tweeted, unprompted.

Meanwhile, New Hampshire families are flocking to the program with 3,025 participating this year, up from 1,572 last year. According to NH Bulletin’s Ethan DeWitt, ​​1,504 out of the 3,025 are eligible for free and reduced-price lunch, meaning 49.7 percent come from households making below 185 percent of the federal poverty level. 

“You’d think the party preaching about equity would be in favor of expanding educational opportunities for all students,” DeAngelis said. “The problem is opposition to parental rights in education is about politics and power, not morality or logic. That’s why 99.99 percent of Randi Weingarten’s teachers union’s campaign contributions have gone to Democrats in 2022.

“But now there’s a new special interest group in town – parents – and they aren’t going away any time soon.”

Bail Reform Brings Sununu, Sherman Together

Changing New Hampshire’s bail reform system, which critics say allows dangerous criminals to walk free, is a top priority for both Republican Gov. Chris Sununu and his Democratic challenger, state Sen. Tom Sherman, D-Rye. 

“There should be outrage and appetite for change,” Sununu told WMUR’s Adam Sexton this weekend.

Sununu signed a bail reform bill in his first term after being assured it would balance public safety and the goal of avoiding putting non-violent offenders in jail for minor offenses. Instead, critics say, serious criminals are being released and reoffending.

“I signed it because it had the support of law enforcement,” Sununu said. “I said ‘Will this work?’ Everyone believed it would be OK, so we signed it. But we all see what was happening.”

Sununu was referencing the August murder of an elderly Manchester man by a suspect who had been arrested twice in the weeks leading up to the stabbing.

Manchester resident Daniel Whitmore, 75, was found with multiple stab wounds on a walking trail near Bradley Street in August. The suspect in the murder, homeless man Raymond Moore, 40, had been arrested twice last summer. Once in July in Nashua for resisting arrest and disorderly conduct, and again in August for another apparent stabbing incident. He was released from custody, and without bail, in both cases.

Manchester’s Democratic Mayor Joyce Craig took to Twitter to decry the state’s lenient bail system.

“Our criminal justice system cannot continue releasing violent offenders back onto our streets. I, once again, urge our legislators to act quickly and address this issue. The safety of our residents is at stake,” Craig said.

During his own WMUR appearance last weekend, Sherman also voiced support for changing New Hampshire’s bail laws to keep violent suspects locked up.

“Do I support rebalancing bail reform? Absolutely. Do I support protecting people from violent criminals? I always have,” Sherman said.

Sherman and Sununu supported the effort this year to change bail laws, but that proposal died in the legislature when the House voted it down. The bill lost support largely from Democratic members. Sherman said too many people did not seem to understand how the bill would work.

“The solution is we have to recognize — whatever we do for bail reform, we have to make sure the system will support it,” Sherman said. “That was the problem. The system did not support, with adequate scrutiny, who was being released and who was not.”

Sununu blames the left, especially progressive organizations like New Hampshire’s ACLU, for blocking the bail reform effort.

“You have the ACLU, these extreme left-wing groups that say they do not want to change anything,” Sununu said. “You have individuals that get arrested, they are getting out before the cop that arrested them has done the paperwork. It is messed up,” Sununu said.

New Hampshire’s ACLU claims the bail laws allowing more people to be released from custody has made New Hampshire safer. They say instead of finding ways to keep more violent suspects locked up, the legsilators should fund more community needs.

“Lawmakers should focus our limited tax dollars on investments that will actually make our communities safer and more just, like housing, transportation, and mental health and substance use treatment,” the ACLU stated earlier this year. “Pretrial detention has a devastating human toll. Even for a short period of time, it increases the likelihood of innocent people pleading guilty to a crime, loss of employment, income, and housing, and traumatic family disruption.”

The conservative Americans for Prosperity also opposed this year’s bail reform efforts, but it does support changes to the law. Ross Connolly, AFP’s deputy state director, said the organization wants to see bail commissioners replaced with magistrate judges when it comes to deciding who can be released and who needs to stay locked up.

“Pre-trial detention is a balance between public safety and the presumption of innocence,” Connolly said. “We understand the concerns with bail, and there is a way to address the issue without throwing out individual rights. Replacing bail commissioners with a magistrate system is a fix that all sides can get behind.  A magistrate system will improve public safety, will pass the legislature, and will cost Granite State taxpayers less than other proposals.” 

Despite Court Ruling, House Dems to Keep Fighting For COVID Exceptions

Democrats are vowing to keep up the fight over COVID-19 restrictions at the State House even as more voters are ready for an end to pandemic living.

On Monday, the First Circuit Court of Appeals in Boston denied New Hampshire Democrats an injunction against House Speaker Sherman Packard (R-Londonderry). Democrats have been pushing for Packard to allow for remote attendance for legislators. House Minority Leader Rep. David Cote (D-Nashua) responded by saying he would continue the remote legislation lawsuit.

“While we are disappointed that the First Circuit denied our request for a preliminary injunction, it is important to note that the court did not rule that disabled people must risk death to serve in the legislature and represent their constituents. The court’s decision only related to a preliminary injunction, not the Speaker’s denial of minimal accommodations for representatives with disabilities,” Cote said in a statement.

Cote, 61, lives with cerebral palsy and has not been to Concord for a vote in more than two years. He did not respond to a request for comment on Monday.

Packard successfully argued that as Speaker he enjoys “legislative immunity” and is exempt from following the Americans with Disabilities Act, and therefore the injunction fails.

“This opinion reaffirms the importance of the integrity of the legislature and the legislative process. Both the First Circuit and District Court evaluated the plaintiffs’ arguments and ruled against them. My next step is to continue working on legislation that will benefit the state of New Hampshire and keep pushing us forward,” Packard said in a statement.

Spencer Kimball, an associate professor at Emerson College and the director of the school’s polling center, said the politics of the pandemic have shifted away from favoring Democrats as the virus has become less threatening.

“I have been looking at COVID restrictions and see a big difference nationally between Democratic voters where 38 percent see COVID as a major health threat, while that number is about 17 percent among independents and 14 percent among Republicans,” Kimball said.

The COVID-19 virus seems to be in retreat, with cases and hospitalizations dropping drastically in recent weeks across the country and in New Hampshire.

Earlier this week, state Sen. Tom Sherman, (D-Rye) who is running to unseat Gov. Chris Sununu, was asked if he would impose a mask mandate “on day one” after taking office. “It really depends on the numbers,” Sherman said. “You have to look at what’s called the epidemiology, which is how pervasive is it in the community.

“If the numbers say it is [necessary], then we may need to do that, but that would not be my first response, Sherman added.

Kimball said, with the threat perception changing, COVID restrictions could be a loser for Democrats heading into the midterms.

“Democrats may be overplaying their COVID hand, but if COVID was to increase they may find themselves in a stronger position. Time will tell,” Kimball said.

In New Hampshire, most adults have some level of protection against COVID-19, according to recent UNH Survey Center data.

Currently, one-quarter (of adults) say they have tested positive for COVID since the pandemic began. Six in 10 adults say they are vaccinated and boosted, another 17 percent are vaccinated but not boosted, and 22 percent are not vaccinated at all. Overall, seven in eight Granite Staters likely have some protection against COVID-19 through vaccination or recent infection,” The UNH data report states. 

David Paleologos, director of Suffolk University Political Research Center, said Democrats need to be alert to parents who are tired of mask mandates and school lockdowns harming their children.

“It’s hard to say whether or not mask advocacy on its own will be a cutting issue in November. More likely is a scenario where Democrats will say mask policies and required vaccinations ultimately saved lives and Republicans will say that mask mandates were an overreach, setting back education a couple of years,” Paleologos said. 

Democrats who align with teachers unions, which have backed stricter COVID restrictions like remote learning and masking, have had a rough time at the ballot box.

“Traditionally, education and healthcare are wheelhouse issues for the Democratic Party. If Republicans chip away at these two pillar issues (like they did in Virginia and New Jersey last fall), Democrats may face some dark November days,” Paleologos said.

Glenn Youngkin took the Virginia governor’s race, in part, because parents were upset with COVID lockdowns. In New Jersey, incumbent Democratic Gov. Phil Murphy barely beat a challenge from Republican Jack Ciattarelli.

Cote took over the leadership after the death of state Rep. Robert “Renny” Cushing (D-Hampton.) Cushing died this month following a two-year battle with prostate cancer. His family told The New York Times Cushing’s death was partially brought on by complications from COVID-19.

Cushing first brought the lawsuit to the federal court and pushed for a ruling on the appeal for the injunction ahead of the current legislative session. Even as he was dealing with cancer treatments, Cushing remained active throughout the pandemic, missing few votes over the last two years.
