House Approves Full-Day Kindergarten, Democrats Claim Legislative Victory

In a win for Gov. Chris Sununu’s agenda, the New Hampshire House gave a preliminary vote of approval for full-day kindergarten. While some are calling it a bipartisan victory, the state Democratic Party is taking credit for the proposal getting passed.

Senate Bill 191 calls for providing $14.5 million during the next two fiscal years to help communities that want to implement full-day kindergarten.

In Sununu’s budget proposal, he provided $9 million a year to establish programs in the neediest communities of the Granite State. That original funding amount passed the Senate at the end of March on a 21-2 vote.

The House Education Committee changed the funding to the full $14.5 million to allow all communities, regardless of need, the opportunity to implement the program. About three-quarters of New Hampshire’s communities currently have full-day kindergarten, but the state only pays half the per-student amount for children in kindergarten. The House approved that funding on Thursday on a 247-116 vote.

“I applaud the House for taking this important step today to provide financial support to communities that choose to support and create full-day kindergarten programs,” Sununu said in a statement. “I believe strongly that this is the right thing to do and I look forward to continuing to work with the legislature as the measure moves forward.”

The roll call vote saw 87 Republicans join 160 Democrats in supporting the bill. Many education advocates cheered the bipartisan work of the House and Senate for getting the bill passed.

“With today’s vote, strong bipartisan majorities in the House and the Senate are on record supporting increased state funding for full-day kindergarten,” said Mark Shriver, president of Save the Children Action Network. “We are encouraged that lawmakers from both parties have made investing kids in the Granite State a priority.”

The New Hampshire Democratic Party framed it another way. In their own press release, chairman Ray Buckley called Sununu’s original proposal of funding full-day kindergarten at $9 million a year a “half-baked plan.” He also highlighted that no Democrats opposed the bill and a majority of Republicans (115 of 202) voted against the legislation.

“Today, Democrats held him accountable for his broken promise by finally providing every child in the state full-day kindergarten instead of ceding to his half-baked budget proposal,” he said. “Democrats carried the bill across the finish line in the House, with every single Democratic House member voting for the legislation while a majority of Republican members voted against it. Sununu’s inability to lead almost cost us full-day kindergarten. Today was another example of why we need Democrats in the State House.”

House Republicans are pretty divided over whether the state should pay for full-day kindergarten.

On the House floor, Rep. Victoria Sullivan, R-Manchester, said she opposed the bill because it removes local control from the communities and removes parental choice.

“It was never intended that 5-year-olds would be sitting at a desk for six hours per day,” she said. “We must allow districts to keep decisions regarding early childhood education as a local control issue so that we can fix Kindergarten and restore it to its intended purpose, which is to foster the individual talents and abilities of each child through exploration, creativity and movement.”

Other Republicans say the bill doesn’t mandate that schools offer full-day kindergarten, but simply allows communities access to funds to help pay for it.

“If Kindergarten is important, why don’t we fund it for everyone?” said Rep. Terry Wolf, R-Bedford. “This bill helps offset the downshifting of costs from state to local communities. Funding education makes a statement that we value education and support our communities.”

SB 191 was one to watch on Thursday because House GOP leadership did not take an official position on the bill or whip any votes. House Speaker Shawn Jasper was presiding over the session, so he didn’t cast a vote, but House Majority Leader Dick Hinch voted in favor of the legislation.

Leaders of the two conservative House caucuses voted against the bill, showing there isn’t widespread support among those factions for full-day kindergarten. Rep. Laurie Sanborn, R-Bedford, who is a leader of the House Republican Alliance, and Rep. J.R. Hoell, R-Dunbarton, who is a leader of the House Freedom Caucus, opposed the bill.

SB 191 now heads to the House Finance Committee for representatives to look at the cost since the measure uses state revenues. In an earlier session, members of the committee refused to put any money for kindergarten in its version of the state budget.

After the committee makes a recommendation, the bill returns to the full House for another vote. If the House approves funding again at the $14.5 million-a-year level, then it will go to the Senate.

The Senate could then approve the bill at that funding level or the chamber could reject it in favor of their previous $9 million-a-year plan for targeted communities. If that happens, it’s likely a committee of conferences between the two chambers would be established to negotiate a compromise.

Regardless, the House’s approval of full-day kindergarten on Thursday is a good indication that a bill at some funding level will end up on Sununu’s desk, fulfilling one of his campaign promises.

New Hampshire Blows Opportunity to Become Nation’s Leader on Education

In New Hampshire, it’s déjà vu all over again. The House Education Committee just voted to retain Senate Bill 193, which would have established a universal education savings account (ESA) program in the state. The “Education Freedom Savings Accounts” would have granted parents of public school and homeschool students access to 90 percent of their child’s state public education funding and up to 50 percent for kindergarten students to spend on educational alternatives, such as private school tuition, homeschool textbooks, tutoring services, and learning therapies.

The Democrats in the New Hampshire House pulled out the tired, old, baseless arguments liberals of the education establishment have been using for years: “Our New Hampshire Constitution is clear that private funds cannot be used for sectarian purposes,” state Rep. Mary Heath (D-Hillsborough) said. “This bill undermines public education.”

“Rep. Tamara Le, D-North Hampton, said she was concerned that the bill could siphon between $75 million and $100 million away from the public school system,” the New Hampshire Union Leader reported.

Unfortunately for New Hampshire families, representatives of the “Live Free or Die” state would rather watch children’s educations be destroyed under the greedy guidance of the teachers unions who control them than give students access to a variety of educational choices.

The claims made by public-education advocates are no more accurate than their so-called “concern for the children” is believable. State supreme courts have ruled in Arizona and Nevada Blaine amendments—provisions borne out of anti-Catholic bigotry of the late 19th century that prohibit public money from funding “sectarian” institutions—do not make ESAs unconstitutional, because it’s the parents who sometimes choose to spend the money on religious schools, not the state.

EdChoice reports, “Public data show that states and cities typically increase their per-student spending in the years following school choice programs’ inception.” For example, EdChoice found Milwaukee public schools increased per-student funding by more than $5,000 from 1992 to 2011, even though the city instituted a school choice program in 1990 that many supporters of the education status quo said would cripple public education.

Rep. Heath should be aware of the precedent set most recently and dramatically in Nevada, and Rep. Le should know the “school choice drains public school funding” narrative is a myth. These legislators are either shamefully ignorant and/or misinformed or they’re simply choosing to ignore the facts. Either way, lawmakers who deny reality in favor of their special interests are unqualified to tell parents they have no right to customize their child’s education to fit their needs.

New Hampshire had the opportunity to pave the way for the nation, to show what living free in the spirit of the American way truly means. But the power of the teachers unions and the control they have over Democrats (93 percent of the $33.2 million teachers unions gave directly to politicians during the 2016 election went to Democrats) was too much for the legislature this time around, and children in the state will continue to suffer in failing public schools because of it.

The good news is that not everyone is taking the Blaine blame game sitting down. The U.S. Supreme Court is in the midst of hearing arguments in a case that could undermine one of the biggest weapons in the pro-public-school people’s arsenal. Trinity Lutheran Church of Columbia, Missouri, alleges its application for a state grant to replace its playground’s gravel surface with scrap tire that’s friendlier to kids’ knees was denied because it’s a religious institution. Trinity Lutheran says the state constitution’s Blaine amendment is standing in the way of a safer playground, and recent reports covering the debates held before the U.S. Supreme Court suggest a majority of the nine justices agree.

It appears there’s momentum to rid the country of the bigoted Blaine amendments at last and move real education choice one step closer to actuality. Let’s hope New Hampshire children don’t have to wait much longer to get access to the educational resources Heath and Le believe they don’t deserve.

One of Gov. Sununu’s Education Priorities Passed Favorably Out of Committee

In a victory for New Hampshire Gov. Chris Sununu, the House Education Committee voted favorably for a bill that would increase state funding for full-day kindergarten. However, a school choice bill was killed for the rest of year.

Sununu has called himself a “believer in school choice,” but had some reservations about Senate Bill 193, which would establish education freedom savings accounts for parents to use taxpayer funds and turn them into personal “scholarships” for students.

The measure would have allowed parents to use the approximately $3,500 that schools receive per student and put the money for tuition in private or religious schools, pay for the costs of homeschooling, or even for supplies to tutor their children. It’s similar to the typical voucher program in other states, but the New Hampshire bill allows parents to use the funds for multiple educational opportunities that they want for their child.

Opponents don’t want taxpayer funds to be diverted from public schools. They also say the program would unconstitutionally provide taxpayer dollars to religious schools. Supporters argue the bill gives parents more options for their students.

The House Education Committee sidetracked the bill Tuesday and voted 15-4 to retain it in committee to study further, essentially killing the bill until 2018.

“There are a lot of aspects to this bill which I think we really need to drill down,” said Rep. Rick Ladd, R-Haverhill, chairman of the committee.

The bill previously passed the Senate on a 14-9 vote in March.

Rep. Mary Heath, D-Manchester, said “this bill undermines public education.”

“Our New Hampshire Constitution is clear that public funds cannot be used for sectarian purposes,” she added. “We have failed to fund our public schools in the manner in which we should fund them. To move to this process would undermine what we have stood for.”

Sen. John Reagan, R-Deerfield, was the author of the bill, and he told reporters after the vote that retaining the bill was due to the result of special interest groups, specifically the unions, who blocked his legislation. He said it was a loss for the students of New Hampshire.

Yet, the bill had bipartisan support in its defeat with several Republican lawmakers saying they wanted to draft a better version of the bill that has a chance of passing in the Legislature.

Rep. Dan Wolf, R-Newbury, said retaining a bill in committee is equivalent to “death with dignity. So let’s hope that this is death with dignity.”

Despite supporting school choice, Sununu raised questions last week about how the legislation could impact public schools.

“I think when it comes to using state money for schools, and I think a lot of people know I’m a big believer in school choice, that whatever we do, we have to make sure we’re not harming public schools,” he told New Hampshire Public Radio. “We’re not just removing funds out of those schools and we understand that as we move money around, what those pros and cons might be. I do have concerns when you start using state funds, whether it be a voucher program, or all the different terms that you want to put for it, to schools of a non-public nature.”

 

FULL-DAY KINDERGARTEN PASSES

At the same committee hearing, on a 15-4 vote, representatives passed Senate Bill 191, which would increase funding for full-day kindergarten, a priority Sununu has pushed this legislative session.

Sununu made a rare appearance before the committee last week, urging the House committee to approve the Senate bill, which was modeled after his original proposal.

In his budget proposal, Sununu called for $9 million-a-year to be given out in grants to the communities with high levels of low-income students and English language learners that wanted to opt for full-day kindergarten programs instead of half-day. The Senate approved of that plan in March on a 21-2 vote.

The House Education Committee voted to amend the bill, recommending that the House fund full-day kindergarten for all communities, regardless of need, that wanted to expand their kindergarten programs. They also voted to increase the cost to approximately $14.5 million per year, which was the same amount that Sen. David Watters, D-Dover, proposed in the first draft of the bill in the Senate.

“Today’s actions are a significant step forward for New Hampshire,” Sununu said in a statement. “Full-day kindergarten is good for children, families, and a critical tool in retaining our workforce.”

The bill will be taken up by the full House next week. If passed, it would be sent to the House Finance Committee for review, before returning to the House for a final vote.

School Vouchers vs. ESA: The School Choice Debate in NH Heats Up

Education Freedom Accounts Serve the Public Good

The House Education Committee heard testimony on a Senate bill Tuesday that would establish “education freedom savings accounts” for students in the state. Emotions ran high during the crowded hearing in what has been a battle of school choice advocates versus supporters of public schools. Yet, the terms “school vouchers” and “education savings accounts” (ESA) haven often been thrown around synonymously at the New Hampshire State House, resulting in misinformation being spread around about Senate Bill 193.

The bill would allow parents of students between the ages of 5 and 20 to work with an approved scholarship organization to receive 90 percent of the per-pupil state grant funds (approximately $3,500) to be used to cover tuition or other costs at a school of the family’s choice. The family can use the funds to pay for private school tuition — including religious schools — homeschooling expenses, and other academic expenses. The bill passed the Senate on a 14-9 vote in March.

Opponents of the bill claim the ESA would take funding away from public schools that need it most, since students from underfunded or struggling school districts would most likely take advantage of the program. The critics also said the program would unconstitutionally provide taxpayer dollars to religious schools.

Supporters argue the bill would give parents more options for their students, since they know what’s best for their own children. They also claim that by granting parents alternatives to public schools, it would create competition and encourage public schools to increase their performance.

“The American education system has substantially failed to produce what they’re charging for,” said bill sponsor Sen. John Reagan, R-Deerfield, at the hearing.

“It is trying to resolve the problem of having the most expensive education system in the world, and not having the best prepared students in the world,” he added. “The argument we hear is, if we take all this money from our public schools – and this is what our public school administrators tell us – they tell us they won’t know what to do.”

Yet, several opponents of the bill have been using the terms ESA and school vouchers interchangeably to describe what the legislation would do.

The state’s largest teacher union, the American Federation of Teachers (AFT-NH), has also been telling its supporters that the ESA bill is code for a school voucher program.

“SB 193 is a voucher bill under the guise of ‘Education Freedom Savings Accounts,'” they wrote on their website.

Voucher programs and education savings accounts are similar, but not identical. However, the distinction between them is often muddled by politically-loaded terms. A state school voucher program grants parents a credit for a certain tuition value that they can use to enroll their child in a private school

ESAs are similar, but offer more flexibility to the parents. When parents get an ESA, they are awarded a yearly sum that can be mixed and matched to suit their children’s educational needs. The funds can be used all for private school tuition, like a voucher, or they can split it among many education opportunities like private tutoring, textbooks, and even saving for college.

The AFT-NH encouraged their supporters to fill out a robo-petition that would be sent to lawmakers encouraging them to vote “no” on SB 193 and creating ESA for students.

“Despite being labeled an ‘Education Freedom Savings Account,’ make no mistake this is a voucher bill which will directly take taxpayer dollars intended for our public schools and divert to private and other institutions,” the petition website states.

House Education Committee Chairman Rick Ladd, R-Haverhill, said his panel would likely vote on the bill at the end of the month. The committee has until April 26 to act on this legislation, at which point, it would probably go to the House Finance Committee before reaching the House floor for a vote.

Due to Republicans holding a slight majority in the House, it’s likely the bill will pass committee. What ultimately happens when it comes to a floor vote in the full House is anyone’s guess.

A recent survey from Citizens Count, NH’s Live Free or Die Alliance found 54 percent of respondents were opposed to “granting parents a portion of state funds to pay educational expenses for private or home-schooled students” and 46 percent supported the measure.

The bill has even grabbed the attention of former Republican presidential candidate and Florida Gov. Jeb Bush, who wrote a Monday op-ed in the New Hampshire Union Leader expressing his support of the ESA bill.

“Empowering parents with the freedom to choose encourages positive change because the right to educate their children no longer can be taken for granted,” Bush wrote. “It must be earned. I commend Sen. John Reagan and Rep. Joseph Pitre for introducing this legislation, and Gov. Chris Sununu, who has been a passionate advocate for school choice.”

There are still some questions to be answered and changes the bill needs before the House votes on it. House Finance Committee Chairman Neal Kurk, R-Weare, said he supports the bill, but the question over funds going to religious schools would need to be addressed. The state constitution expressly forbids taxpayer funds going to religious schools.

Anne Edwards, an attorney with the state’s attorney’s office, warned lawmakers at the Tuesday hearing that if they don’t tweak the bill in regards to the religious school issue, the state could face legal and constitutional challenges.

However, Kate Baker, director of the Children’s Scholarship Fund, said legislators shouldn’t let the threat of litigation stop them from passing the bill.

“I believe this will be in the courts, no matter what you do,” she said. “Parents want to go to court and fight for their right to make these choices for their children.”

The Top 3 School Choice Issues To Watch In The NH Legislature

Not only is it National School Choice Week, it’s also New Hampshire School Choice Week. Gov. Chris Sununu signed the proclamation on Tuesday. So naturally, the discussion of school choice in the Granite State is bound to come up. And the Legislature has a slew of bills related to charter schools, public versus private schools, and parent involvement in their children’s education.

With a Republican-controlled State House, expect to see several school choice bills make it through and end up on the governor’s desk. Education reform is definitely a priority for the Sununu administration.

“We’re not trying to blow up education, or battle public education,” he said at an event for National School Choice Week in Manchester on Tuesday. “I love public education. It’s just about actually taking the system that we have, the fundamental structure that we have — and it’s not bad; it’s a good structure — but providing some leadership to really implement those innovations that we always talk about.”

Here are NH Journal’s top school choice issues to keep an eye on at the State House as lawmakers begin to debate these bills:

 

CHARTER SCHOOLS

There are about 10 bills dealing with charter schools, which is still a contentious topic in the world of education. Here’s a quick run-down of what they are:

  • Charter schools are publicly-funded independent schools that are not subject to the same regulations as traditional public schools.
  • They do not charge tuition.
  • They must accept all students who apply, but if the number of applications exceeds the school’s capacity, a lottery must be held to select students who will be offered a place.
  • They are considered part of the state school system and are accountable to state and federal authorities for compliance with the terms of their founding charter, which often includes achievement-based standards (read: testing).
  • All charter schools must apply for authorization and receive approval from a local school district, a town vote, or the state board of education. Charters are valid for a term of five years, at which point a school must apply for renewal.

There are currently 25 charter schools operating in New Hampshire, with another one slated to open in fall 2017, according to data from the NH Department of Education. There were 3,011 students enrolled in charter schools, or about 1 percent of the state’s total student population, as of October 1, 2015.

Most charter schools receive funding directly from the state, at a rate of about $6,500 per pupil, which is a lower than average per-pupil expenditure at traditional public schools, which averaged approximately $14,375 in 2015. Data from the current academic year is not available yet.

So why are charter schools so divisive? Charter school advocates want more funding and to raise the cap on admittance. They say the schools create new educational models of teaching and learning that appeal to students who might not learn best in a traditional school setting and give parents more choices in their children’s education.

Opponents say charter schools take away state money that could go to improve traditional schools, and they lack equal proportions of disabled or special needs students, who then are forced into the traditional public school system.

And the argument that charter school students perform better on standardized tests is a moot point. While statewide assessment results generally show that trend, the comparisons can be misleading since charter schools and traditional public schools do not have equivalent student populations in terms of learning ability and special needs.

Out of the 10 bills filed for the current legislative session, seven of them seek to place limits on charter schools or give the state more control of them. They are sponsored by Democrats. Three of the bills look to provide more funding or give charter schools more authority — all sponsored by Republicans. So you can see that this issue largely falls on party lines.

Rep. Timothy Horrigan, D-Durham, appears to be charter schools’ biggest opponent by being the prime sponsor on most of the “anti-charter” legislation. But with a Republican governor and a GOP-controlled Legislature, it’s difficult to see a scenario where any of the Democrat’s legislation makes it far. Especially with a pro-charter school governor who wants to increase funding.

And Sununu’s nominee for education commissioner, former state Rep. Frank Edelblut, is also a school choice, pro-charter supporter. It seems unlikely that any of the limiting charter school legislation will make it out of the House Education Committee.

 

THE ‘CROYDON’ BILL

For those unfamiliar with the story of the town of Croydon and school choice, let me fill you in.

The town has been in an ongoing legal battle with the courts and state Department of Education over its decision to send some of its students to a nearby Montessori school at taxpayer expense.

Many small communities in the state do not have a local K-12 school district and they contract with larger nearby districts to send their students to school there, usually though a per-student tuition contract paid for by the town where the students come from.

So, the Croydon School District had a tuition agreement with the town of Newport, but that contact ended in 2014. Croydon gave parents the option of choosing public and private schools to send their children, which would be funded by taxpayers.

The state and courts have ruled that the town cannot use public funds to pay for private school. But the school district says there is nothing in state law that prohibits it from using private schools if it’s in the best interest of the students.

Now, school choice advocates are rallying behind House Bill 557, which would allow a school district to send a child to a private school, even a religious one, if there is not a public school for the child’s grade in their home district.

The first hearing for the bill was held on Wednesday and the state Department of Justice said the bill violates the N.H. Constitution for allowing taxpayer money to be used for religious schools and could lead to other court cases in towns where parents are paying for private schools out-of-pocket.

It’s a tricky bill, but if it makes it out of committee and goes through the Legislature, Sununu is expected to sign it. In an op-ed published in the New Hampshire Union Leader during his gubernatorial run, he said, “the issue in Croydon is a clear example of government overreach.”

“Too often, special interests and unelected bureaucrats act as if they know what is right for children over the judgment of parents,” he wrote. “Instead of expanding options for families, the state has unfortunately been working to reduce them.”

And assuming Edelblut is approved by the Republican-controlled Executive Council, he has also indicated that he supports the Croydon School District, so he could make this bill a priority and work with members of the Legislature to get it passed.

 

COMMON CORE

While not directly about school choice, the issue of Common Core State Standards will be a dividing issue in the Legislature. School choice is all about giving parents a greater role in their child’s education and with Common Core, many parents feel the federal government and state are mandating what their children should learn — even if they don’t believe it’s in their best interests.

Bills in the House and Senate seek to make clear that school districts are not required to implement the standards if they don’t want to.

NH Journal has previously reported on the issue of Common Core in the state and how the state board of education gave towns and cities the flexibility and local control to implement the standards how they saw fit.

Sununu and Edelblut have both said they want to “repeal Common Core.” What exactly that means, is still unclear, but if these bills make it to Sununu’s desk, it’s also likely that he would sign them.

Here are some other bills relating to school choice (or parental involvement) that will appear in during the current legislative session:

  • Constitutional Amendment Concurrent Resolution 7: “The general court shall have the authority to define standards of accountability, mitigate local disparities in educational opportunity and fiscal capacity, and have full discretion to determine the amount of state funding for education.”
  • House Bill 395: “This bill repeals state board of education rulemaking authority for home education programs and inserts the duties and procedures related to membership in the home education advisory council statute.”
  • House Bill 103: “This bill requires school districts to provide advance notice to parents and legal guardians of course material involving discussion of human sexuality or human sexual education.” Here is NH Journal’s story on how that bill came to fruition.

College Campus Free Speech Bill Appears Again in House Education Committee

When Hillary Clinton and Bernie Sanders held their respective rallies at the University of New Hampshire this past year, Joshua Fox and other members of the UNH College Republicans wanted to stand outside the venue, hold signs, and protest.

When they were protesting, a police officer approached them and told them they needed to move to a “free speech zone” because they could potentially cause some safety problems. Fox, a sophomore at the public university, said they were forced into a small area to carry out the rest of their protest, farther away from where people were waiting to enter the rally.

“A diversity of opinions is important to college,” he testified during a House Education Committee hearing in Concord on Tuesday. “I believe every American should have their right to speak their opinion.”

UNH says presidential candidates and their Secret Service teams are allowed to put some policies in place that the university would not normally do.

But Fox said he still believes universities and colleges sometimes go too far in stifling free speech.

He supports House Bill 477 that would limit “the ability of an institution within the university system or community college system to restrict a student’s right to speak in a public forum.”

The bill states that no university or college that receives state funds “shall restrict a student’s right to speak, including verbal speech, holding a sign, or distributing fliers or other materials, in a public forum.”

Rep. Eric Schleien, R-Hudson, is the prime sponsor of the bill, which has five other cosponsors on it — all Republicans. But he said this bill shouldn’t be a partisan bill.

“The broader principle is if I am a student at a public university or college, I shouldn’t have to ask people for permission to hand out a flyer,” Schleien said.

He is referring to UNH’s policy on students needing a permit to “distribute literature” and for “outdoor assemblies.”

“Individual students and non-students who wish to solicit for contributions, distribute literature…and engage in sequential, incidental, brief and transitory verbal interactions with passersby on the sidewalks and in the parking lots on campus must first obtain a permit from the University of New Hampshire Police Department,” states Section 23.2 of UNH’s administrative rules and regulations.

That’s where Joe Cohen, legislative and policy director of the Foundation for Individual Rights in Education (FIRE), has a problem.

He doesn’t believe students should have to get a permit to assemble a protest or pass out flyers to passersby. He also said having the police in charge of the permitting process is a problem.

“We’re not really changing the law in anyway,” he said. “We’re just changing the mechanism to give students the power to exercise their First Amendment rights.”

According to FIRE, most public colleges and universities in the Granite State do not have a high “speech code rating.”

Only Plymouth State College has a “green light” rating — when a college does not “seriously imperil speech.”

UNH and Dartmouth College received a “yellow light” rating. That’s when an institution’s policies “restrict a more limited amount of protected expression or, by virtue of their vague wording, could too easily be used to restrict protected expression.”

Keene State College received a “red light” rating, which “clearly and substantially restricts freedom of speech.”

Cohen criticized the state’s college and university system for not having uniform free speech policies. He believes this bill will help fill that gap.

Reports of free speech violations on college campuses have reached national media outlets in the past year. One of the most recent incidents was at Kellogg Community College in Michigan where members of the Young Americans for Liberty chapter are suing the school after they were arrested in September for passing out pocket-sized copies of the U.S. Constitution without administrative permission.

While no incidents like that have been reported in New Hampshire, the Granite State public universities have seen an increase in hate crimes in the past year. A swastika was burned into the ceiling of a Keene State College dorm and at UNH. President Mark Huddleston said several students and staff had experienced harassment or threats.

Educators on New Hampshire college campuses have been trying to have an open dialogue with students about where freedom of expression ends and hate speech begins.

But Karyl Martin, assistant general counsel for UNH, said the new bill on free speech could be seen as redundant since students are already allowed freedom of speech in the First Amendment and some restrictions exist to keep students safe.

“The safety and health concerns are real,” she said. “The permitting notice allows them [the university] to be flexible to needs of the students.”

Lawmakers were also critical of the law, asking if there were any limits to free speech on college campuses.

Schleien said the courts would ultimately decide what limits exist when they interpret the law.

But Martin said it’s difficult to legislate what are reasonable restrictions.

“It also puts the expense of litigating these issues on the taxpayers when they go to court,” she said. “It would ultimately end up on them and the students.”

 

THE EDELBLUT WILD CARD

This isn’t the first time a bill like this appeared before the committee. In the last legislative session, former Rep. Frank Edelblut, R-Windham, introduced a similar bill (House Bill 1561) that ultimately didn’t make it out of committee.

The main differences between the two pieces of legislation are that the 2016 bill included a clause for “spontaneous and contemporaneous” demonstration. Cohen said he would prefer that to be in the current legislation, but UNH says that could lead to more costs.

Last year, the committee referred the legislation for interim study to look more at what the cost would be for the public university and college systems.

They claimed that the law could increase costs due to litigations and a change in their current permitting system, including additional funds for police officers for those spontaneous protests.

The bill was not recommended for future legislation.

Now, without the spontaneous clause, maybe the bill has a fighting chance. Especially, with the Edelblut wild card.

Republican Gov. Chris Sununu recently nominated Edelblut, who also came in a close second to Sununu in the Republican gubernatorial primary last year, to be the next state education commissioner. As education commissioner, he helps set the tone of the department and implement policy for K-12 education, as well as higher education, which includes the state universities and colleges.

His nomination is already controversial since he doesn’t come from an education background. But now that it’s likely he will be approved by the Republican-controlled Executive Council, Edelblut could help push this legislation forward. After all, he was the one who first proposed it last year.

With Edelblut in Sununu’s ear, he could give this bill a nudge forward in the Legislature.
