NH Republicans Work Together to Pass State Budget, Full-Day Kindergarten

In two legislative victories for Gov. Chris Sununu, he saw Republicans unite to pass a state budget and full-day kindergarten. The New Hampshire House and Senate met Thursday for the final session of the legislative year in their respective chambers, and behind-the-scenes negotiations on the budget led to a win for the NH GOP platform. An $11.7 billion biennium budget is on its way to Sununu’s desk for his signature.

The scene was a joyous one for Sununu and Republican lawmakers in the Executive Council chambers at the State House after the budget vote. As Sununu walked into the room, cheering and applause broke out to celebrate their victory.

“Absolutely a big win, a big win for New Hampshire,” Sununu said after the vote. “People sent us to Concord to get a job done and we did it. And we did it the right way, we brought folks in and we listened and we talked, we kept working it the best we could and we came out with what I think is incredible progress for the state of New Hampshire.”

The Senate passed a committee of conference spending plan on a party-line vote of 14-9 in its Thursday morning session. About an hour later, the House passed the same budget on a roll call vote of 198-169. Only 14 Republicans voted in opposition and five Democrats supported the budget.

The margin of passage was wider than many people expected. Just a week ago, the fate of the budget in the House was uncertain, after conservatives tanked an earlier version of the budget in April. After some wheeling and dealing with Sununu and GOP Senate leadership, members of the conservative House Republican Alliance and House Freedom Caucus said while it was an imperfect budget, it was something that had some benefits for Granite Staters.

“Although the caucus as a whole is still concerned about the level of spending, there are definite benefits for the NH taxpayers,” the Freedom Caucus said in a statement. “The majority of our caucus members were able to support the budget in order to bring these benefits to our constituents.”

The business tax cuts added by the Senate were a significant factor in motivating the conservatives to vote in favor of the budget.

“There are many Republican leaders to thank for the passage of this bill — [House] Speaker [Shawn] Jasper, Senate President [Chuck] Morse, and Governor Sununu united the party in Concord and ensured passage of this Republican budget,” said NHGOP Chair Jeanie Forrester. “Republicans of all backgrounds and stripes united to pass this budget and ensure a stable and bright future for the State of New Hampshire. This shows that when Republicans are united, Republicans win and New Hampshire is better off for it.”

A companion bill that made the policy changes reflected in the budget also passed the Senate by a 14-9 margin and in the House by a vote of 212-161.

The companion bill included a phase-in of business tax cuts, elimination of the electricity consumption tax, and authorization of online lottery games. The budget will take effect on July 1, the first day of the new state fiscal year.

While Republicans claimed a win for their legislative agenda, New Hampshire Democratic Party Chairman Ray Buckley sent a fundraising email to supporters, blasting the GOP-backed spending plan.

“Gov. Sununu’s reckless and dangerous budget will take New Hampshire’s progress and turn it into disrepair,” Buckley said. “Republicans assume New Hampshire’s problems will just fix themselves. That’s not leadership, that’s ignorance. Let’s work together to make sure we have the state government we deserve in Concord.”

Later in the day, the House and Senate also passed another of Sununu’s policy priorities: funding for full-day kindergarten. The funding starts with state dollars, but after two years, it would be funded from revenue generated by newly authorized Keno.

Over the legislative session, Sununu stuck by his campaign promise to see full-day kindergarten come to fruition. He called for it in his budget, stood by his pledge after House Republicans stripped its funding from their budget, and then applauded once the Senate revitalized it as a standalone bill. He showed his flexibility when the policy and funding levels changed each time and while the final bill was not what he originally intended, he called it a “first-step.”

The House overwhelmingly passed Senate Bill 191 on a roll call of 251-111. The Senate vote was 15-8, with 12 Republicans and three Democrats in favor, and two Republicans and six Democrats opposed.

It was a difficult bill for some lawmakers to stomach tying online gambling revenue to education. For Sen. Lou D’Allesandro, D-Concord, he’s been a longtime advocate of casino-style gambling in the state, but he voted against the bill since he didn’t believe the two issues should be linked.

On the opposite end, Senate Majority Leader Jeb Bradley is not a big supporter of Keno, but he voted in favor of the bill to invest more in early education.

Still, the bill made it through the legislature and is headed to Sununu’s desk, who applauded its passage and declared that he is “the first governor” to deliver a full-day kindergarten.

“The investments made today will give New Hampshire’s children a strong foundation for tomorrow’s future,” he said. “I am proud to be the first governor to deliver a real full-day kindergarten program for communities across our state, which will close the opportunity gap and provide students, regardless of their economic status, an extra step up as they enter the first grade. Full-day kindergarten is good for children and families, and a critical tool in retaining our future workforce.”

NH House Republicans May Have Enough Votes to Pass State Budget With Conservative Approval

After weeks of uncertainty and negotiations, it appears the Republican-controlled legislature could have enough votes to get the state budget passed Thursday, after key conservative groups indicated they intend to vote in favor of the spending plan.

Both the House and Senate are voting on an $11.7 billion, two-year spending plan negotiated by a committee of conference earlier this month. The Senate is expected to approve the compromise, but its fate is less certain in the House.

Gov. Chris Sununu, NHGOP Chair Jeanie Forrester, and House Speaker Shawn Jasper have been quietly making the rounds to appeal to the conservative caucuses in the New Hampshire House. The House Republican Alliance and House Freedom Caucus had concerns about increasing spending over the previous biennium. GOP leadership appears to have quelled those worries after business tax cuts were approved in the final version of the state budget during the conference committee between the House and the Senate.

No members from the two conservative blocs sat on the budget conference committee, which also harbored some bitter sentiments from representatives.

“While the caucus as a whole, finds the level of spending objectionable, we were able, with the cooperation of the Senate, to craft a bill that will have some positive outcomes for New Hampshire taxpayers, and businesses,” said Rep. Anne Copp, R-Danbury. “Many of these points were clear objectives for the [Freedom Caucus] when we went to House leadership in the early stages of the budget process. It is unfortunate that some of House leadership chose to exclude us from the process.”

At first, it was unclear if House GOP leadership would choose to work with the Democrats or conservatives to get a budget passed in the chamber. After anti-abortion language was added to the bill in the conference committee, Democrats said they would oppose the budget.

“What businesses need, with one of the lowest unemployment rates in the country, is a well-qualified workforce, to maintain our quality of life in the Granite State and a sound infrastructure. It isn’t a tax cut,” said House Minority Leader Steve Shurtleff at a Wednesday press conference with more than 30 other Democratic lawmakers.

With their entire caucus planning to vote against the budget, House Republicans cannot afford to lose more than 25 to 30 votes within their own party, depending on how many of the 400 representatives show up to vote.

The conservatives led the defeat of the House’s original budget proposal in April, after 32 Republicans joined Democrats to vote against the plan. It was the first time since at least 1969, when records were first kept, that the House failed to produce a budget to pass on to the Senate.

Despite several conservative endorsements on the final version of the budget, they are not giving the credit to Jasper. The speaker and conservatives have not exactly seen eye-to-eye on many issues this legislative session. Some even blamed him for not getting a budget passed in April because Jasper didn’t give in to their demands. For the budget that came out of the conference committee, some conservatives attributed their change in position due to the governor and Senate leadership.

“The Freedom Caucus cannot thank the Governor and Senate Leadership enough for the work they have done to deliver a budget that is more fiscally responsible, often having to fight House leadership to lower spending and reduce taxes,” said Rep. John Burt, R-Goffstown. “There can be no doubt that it is a bizarre situation when the Senate President and Senate Finance Chair have to work to bring the House Republican caucus together, but that is precisely what happened, and this budget undoubtedly would have collapsed without their efforts.”

Senate Finance Chair Gary Daniels, R-Milford, said he was pleased to hear that members of the House Republican Alliance and House Freedom Caucus would vote for the budget.

“It was important to the process to have input from these legislators regarding elements they felt needed to be included in the proposed budget, and their interaction helped shape the final product,” he said. “What we achieved is a budget that is good for New Hampshire and provides resources for a strong economic future by balancing key priorities, providing personal and business tax relief and growing the state’s rainy day fund, while keeping overall state spending within responsible levels.”

There are still some conservatives that plan to vote against the budget, but whip counts total defections at no more than 25 members. Still, it’s expected to be a close vote and Sununu was optimistic, yet cautious.

“You never get anything by raising your voice and threatening,” he told New Hampshire Public Radio. “No, open positive listening. And when you bringing people in and talking to them and you are opening, and listening, it’s amazing what you can get done.”

GOP Budget is Good for New Hampshire

If you like laws and sausages, you should never watch either being made. That old adage could be applied to the current session of the New Hampshire General Court.

Drafting and adopting the state budget has been messy as different Republicans have argued passionately for what they believe is in the best interest of the Granite State. But while the process may sometimes be unpleasant to watch, the outcome is generally good and beneficial.

So it is with the Republican compromise budget, which the House of Representatives takes up this week. The budget respects taxpayers while still providing for needed services for New Hampshire’s most vulnerable, such as the mentally ill and those struggling with addiction. Here are four features that you may not have heard about the legislation:

  1. Drugs and Alcohol: The budget doubles funding to the Governor’s Commission on Alcohol and Substance Abuse Prevention, Treatment and Recovery. It establishes a youth inpatient and outpatient treatment center in Manchester. And it more than doubles the budget of the Bureau of Drug and Alcohol to help address the state’s opioid crisis.
  2. Mental Health: The budget establishes 60 new beds for community treatment options and it creates a fourth rapid response mobile crisis unit to keep hospitals from having to shoulder all the burden for mental health issues.
  3. DCYF: The Division of Children, Youth and Families is a system that has failed to do an adequate job of protecting New Hampshire kids and this budget begins to address that problem. It adds new case workers to deal with huge caseloads. It creates an Office of the Child Advocate to provide oversight from outside of the department. And it requires the lead attorney of DCYF to be supervised by our state’s attorney general, which will help when prosecutions are necessary.
  4. Rainy Day Fund: The budget would grow our state’s rainy day fund from an anemic $9 million to $100 million, which would be useful in a pinch but would also help shore up New Hampshire’s top rate bond rating, so we can finance debt with very low interest.

Of course, this budget also sets the stage for a small business-friendly economic environment, which will spur better jobs and higher wages. And it invests in our shared future by making major priorities of education and public safety.

This roadmap for the 2018-2019 biennium contains no new taxes of fees. None. In fact, the budget focuses on economic growth by lowering both the business profits tax (BPT) and the business enterprise tax (BET) to allow for a friendlier business environment. Over the next few years, business will be able to grow and reinvest in the economy. The New Hampshire tax code will also be aligned with the federal tax code and allow for 179 more deductions, greatly helping small businesses.

This is all based on realistic revenue projections to create a finically responsible budget with modest increases of 1.8 percent and 2.0 percent over the next two years. This is the kind of sound fiscal management taxpayers have come to expect from Republican leadership in Concord.

As a former chair of the Senate Finance Committee, I know as well as anyone that putting together a budget is challenging work. Recall also that former Gov. Maggie Hassan, now U.S. senator, shamefully vetoed the Republican budget last summer in a harebrained political stunt that blew up in her face. In the end, she was forced to back down and sign the GOP budget.

And as a result New Hampshire presently has the third fastest growing economy in the nation. That’s real leadership and sound fiscal management. The Republican budget is good for the economy, good for working families and great for New Hampshire.

Log Cabin Republicans Create New Chapter in NH, Seek to Unify GOP

There’s a new political organization in New Hampshire, and it’s hoping to show that the Republican Party is inclusive of all people. It’s often a talking point for the left that the GOP is not welcoming, but the newly-founded NH Log Cabin Republicans wants to change that.

“We want to show that the Republican Party is inclusive and not this monster that we’ve been painted as across the country,” said Adam Lord, chairman of the NH Log Cabin Republicans. “We wanted to show the country this is how we do things in New Hampshire.”

The group held their official launch party on Friday in Portsmouth, which saw more than 100 people attend, including top Republican leaders in the state, including Gov. Chris Sununu, House Speaker Shawn Jasper, and Senate President Chuck Morse.

The New Hampshire and Indiana chapters launched around the same time, bringing the national organization’s total to 51 chapters in 27 states and the District of Columbia.

“With new strongholds in the ‘First in the Nation’ state and the home of our country’s sitting Vice President, Log Cabin Republicans continues to expand our presence throughout the United States,” said Log Cabin Republicans national president Gregory Angelo in a statement.

“The leadership teams of our newly minted New Hampshire and Indiana Chapters are organizing dynamos with keen political instincts,” he added. “I expect big things are in store for Hoosiers and Granite Staters alike as, together, we continue to make the case for common-sense conservative principles and LGBT inclusion in the GOP.”

Sununu was the keynote speaker for the New Hampshire launch and his message focused on how the mission of the Log Cabin Republicans aligns with the goals of the state Republican Party.

“When you talk about things like the LGBT community, or talk about diversity…let’s remember: when we stay together, we have that momentum,” he said. “When we’re talking about what we’re doing here tonight, what the Log Cabin Republicans represent for the state of New Hampshire — frankly, represent for the entire country — is a team effort, staying together.”

That message is crucial for Republicans in the State House. Throughout the legislative session, there has been a very public display of the division in the GOP. The state budget debate in the House largely failed due to conservatives siding with Democrats to go against the House leadership’s wishes. The New Hampshire Democratic Party (NHDP) hopes to capitalize on the divided caucus in the 2018 elections in order to take back the Corner Office and get majorities in the legislature.

“We want to help Republicans win elections and create an outlet for LGBT candidates to go to the party and say these are the values we stand on,” Lord said. “A lot of the higher Republican officials said ‘we are ready to talk about this.'”

A major criticism from the NHDP is that the Log Cabin Republicans identify with a platform that is anti-same sex marriage.

The NHGOP platform states that the party recognizes “marriage as the legal and sacred union between one man and one woman as ordained by God, encouraged by the State, and traditional to humankind.”

In her parting speech in January, former NHGOP Chair Jennifer Horn called for the NHGOP to drop its opposition to gay marriage.

“The next time we gather to review our platform, we must preserve our voice as the party of equal rights for all and remove the language that opposes the right to marriage for all people,” Horn said before the state committee voted for Jeanie Forrester to succeed her as chairman.

“But we cannot be the party of individual rights, limited government interference, and personal responsibility while at the same time advocating to deny rights to any individual just because they are gay,” she added. “Here in New Hampshire, our party has hired gay staff, nominated gay candidates, and elected gay party leaders. Let us make this right, not because it is politically correct, but because it is the conservative thing to do, and it is the right thing to do.”

Lord agreed that there are aspects of the platform they would like to change, including its definition of marriage, but the NH Log Cabin Republicans recognize that it could take some time before substantial change is made. His goals for the group include being officially recognized by the NHGOP’s state committee and to get the word out across the state, by going to various town GOP committee meetings, that the organization is open for business.

“You don’t have to be gay to be part of our organization. We are still conservative,” he said. “Just because we don’t identify with one aspect of it [the platform], we can still be a socially liberal, fiscally conservative part of the Republican Party.”

House Votes to Review Controversial Online Comments From Fisher, Frost

In an unusual move, the New Hampshire House of Representatives voted to review controversial comments made online by two lawmakers. Yet, Republican leaders aren’t expecting the committee to find that they violated any House ethics codes.

It started as an inquiry into Rep. Robert Fisher, R-Laconia, and comments he made in an online forum that were construed as misogynistic, but Republicans successfully added Rep. Sherry Frost, D-Dover, in the inquiry for tweets she wrote earlier this year that some found “offensive.”

Before the House met in their regularly scheduled session on Thursday, it was anticipated that House Democratic Leader Steve Shurtleff would bring up a motion for a House committee to investigate Fisher’s comments.

“At any time any member says anything or does anything that holds this body in disrespect, it affects each and every one of us,” he said on the House floor.

Fisher was identified as the creator of a a Reddit forum called “The Red Pill” in a report from The Daily Beast last week. His posts on the message board garnered criticism for being disrespectful toward women and normalizing rape culture. He admitted to the comments, which were made as far back as 2008, but said they were taken out of context.

Republican Gov. Chris Sununu and New Hampshire Republican Party Chair Jeanie Forrester have called for his resignation, but Fisher insists he will not step down.

Frost posted tweets earlier this year that said more terrorism is perpetrated by “white men who claim Christianity than by Muslims in the USA.” She also tweeted, “The people (read; men) telling me to ‘calm down’ & ‘not take it so hard’ are making me homicidal.”

The NHGOP criticized her for the tweets, calling her a “radical” and “a threat to her colleagues.”

“All representatives should be held to the same standard,” said Rep. Victoria Sullivan, R-Manchester, who put forward the amendment to include Frost. “This body cannot pick and choose who they support and who they do not.”

The House voted 182-180 to include Frost in the inquiry and then approved of the investigation of both lawmakers by a 307-56 vote, with Fisher and Frost voting in favor of the review.

“I think the truth will be out at the hearing,” Fisher told the Concord Monitor. Frost said she has nothing to hide.

The Legislative Administration Committee’s reviews will be limited to comments made by the two lawmakers during the current legislative session, which means Fisher’s previous posts will not be included, but Frost’s tweets will be reviewed.

After that, the committee will make a recommendation to the full House for each lawmaker. The committee could recommend that no action should take place, or that the representatives should be reprimanded, censured, or expelled. The House will then vote on the recommendations.

“Referring this matter to the Legislative Administration Committee will allow for an investigation into Representative Fisher’s involvement with this forum since his election to the New Hampshire House,” Shurtleff said in a statement. “As elected officials it is our duty to act with honor both inside the State House and out, and I am confident that the Legislative Administration Committee will give this serious matter the consideration it deserves.”

His statement didn’t include any comments about Frost, though.

Some lawmakers criticized Republicans for including Frost in the inquiry, saying the two lawmaker’s comments do not equate to equal treatment. New Hampshire Democratic Party Chairman Ray Buckley took to Twitter to criticize the decision.

Yet, House Speaker Shawn Jasper admitted that he doesn’t believe the committee will find that the lawmakers violated any ethics codes.

“I don’t think we’ve ever done anything quite like this,” he told the New Hampshire Union Leader. “Normally there would be something that falls under the ethics guidelines, and there’d be a complaint made by somebody and it would go to the ethics committee.”

Some lawmakers questioned why they spent time debating the issue.

Rep. Keith Ammon, R-New Boston, motioned to table the matter, but it overwhelmingly failed.

“This is being used as a political football,” he said. “We need to have some more harmony in this body.”

Protesters lined the hallways of the State House and gathered outside on the plaza to protest Fisher’s comments. A protester’s sign said, “Rep. Fisher: This feminist says resign!” Another read, “Rape culture: He isn’t a symptom, he is a disease. Fisher must go.”

Fisher’s review hearing will begin on Tuesday, with Frost’s review to follow on Wednesday.

What Options Can House Leadership Take in Fisher Scandal?

The news story that has made the rounds this past week involved accusations that a New Hampshire lawmaker created a misogynistic online message board, making derogatory and inappropriate comments about women. Gov. Chris Sununu and the New Hampshire Republican Party have called for Rep. Robert Fisher, R-Laconia, to resign, but he refuses to do so. This leaves House leaders with only a few choices on how to handle the situation.

The Daily Beast first reported Tuesday a link between Fisher and the online Reddit forum “The Red Pill.” The Red Pill currently claims 200,000 subscribers as a “discussion of sexual strategy in a culture increasingly lacking a positive identity for men.”

In 2012, Fisher, under the alias “pk_atheist,” created the The Red Pill forum near the end of his first campaign for the N.H. House of Representatives, in which he ran as a Democrat. In 2014, he switched to the Republican Party and is now serving his second term in office. He currently doesn’t sit on any committees, at his own request, and out of the 114 votes so far during the 2017 session, Fisher has cast votes in about half of them.

Fisher is under fire for openly questioning whether “rape is bad.” He wrote, “I’m going to say it — Rape isn’t an absolute bad, because the rapist I think probably likes it a lot. I think he’d say it’s quite good, really.”

He also wrote that women’s personalities are “lackluster and boring, serving little purpose in day to day life.” And once commenting that, “it is literally the [female] body that makes enduring these things worth it.”

At first, Fisher denied the allegations. In response to journalist inquiries, he said he would “stand strong for men’s rights.” On Thursday night, he admitted to writing the posts but said most of his comments were taken out of context.

“It was a debate about absolute truth that was recurring on my forums back in [2008],” he wrote in an official statement published by The Laconia Daily Sun. “The default position for most on the aptly dubbed ‘gripe corner’ was devil’s advocate, which made for lively debate. As it turns out, context is very important when quoting somebody. I suspect they teach it in journalism courses, but it seems like it should be basic common sense.”

Sununu, House Speaker Shawn Jasper, NHGOP Chair Jeanie Forrester, and House Democratic Leader Steve Shurtleff called on Fisher to resign, but he is refusing.

“I’m going to continue fighting for what I believe in. Smaller government, lower taxes, more liberty, gay, straight, and transgender rights, (yes, for all my supposed small mindedness and misogyny, I’m firmly pro LGBT) and family court reform,” Fisher said. “For those of you who read this entire thing to see my resignation, sorry to disappoint.”

Jasper said Fisher’s statement lacked an apology.

“I read his letter twice and really viewed it as just going around and around the barn,” he told WMUR. “I didn’t see it as an apology or walking anything back. I thought it was a very circular argument that didn’t change anything.”

The story about Fisher’s involvement with the online forum sparked a firestorm on Twitter, with many national media outlets reporting on the controversy. Several state legislators are also calling on him to resign.

“Lately though, it has been hard to find things to be proud of in the State House,” wrote Rep. Debra Altschiller, D-Stratham, in a Saturday op-ed on the Concord Monitor. “I am not proud, in fact I am devastated and sad to say that rape culture is pervasive at the State House.”

Expect to see lawmakers take to the House floor in its executive session on Thursday to discuss the scandal and call on him to resign. However, House leaders are limited in what they can do.

While most people agree that Fisher’s comments are inappropriate, they don’t technically go against House standards since they are just words and not actions. There are steps the House could take to remove Fisher from office. The state constitution gives the House the power to expel, censure, or reprimand a member for disrespect to the body, but historical precedent makes it unlikely that anything will be done.

The last time a state representative was expelled was in 1913 and that was for taking bribes. There have been many lawmakers over the years, though, who have faced possible removal, but they have usually stepped down on their own.

For example, in 2016 former Rep. Kyle Tasker stepped down after an arrest on drug charges and accusations that he used a computer to lure a teenage girl for sex. Also, Rep. Al Baldasaro, R-Londonderry, said Hillary Clinton should be shot by a firing squad for treason. Many called for his resignation, but he still currently serves as a representative.

In Fisher’s case, there are three ways the House could “punish” him. The Legislative Ethics Committee could recommend expulsion, censure, or reprimand after they look into it in a mostly closed-door procedure.

The second way he could be punished is for a House member to make a motion from the floor, where there would then be a debate, and then a vote. This could be a possible method some lawmakers take during Thursday’s session, but it’s still unlikely anything would happen in a Republican-controlled House.

The third option would be to appoint a special committee to investigate the matter in a nonpublic session and then release the findings to public. Jasper indicated he prefers this method if it came up.

Yet, it’s increasingly likely that the voters in his district will ultimately decide what to do. If Fisher decides to run for reelection next year, the voters could kick him out of office. Only time will tell if the legislature or the voters will decide Fisher’s fate.

Progressive Outside Groups Weigh In on New Hampshire Voting Rights Bill

Outside groups often funnel money into states during an election, but many New Hampshire residents were probably hoping it would be some time before they again face the onslaught of more political ads. Yet, two progressive groups are currently spending money in New Hampshire, trying to influence how lawmakers decide on a voting rights bill that would tighten the state’s voter ID and registration laws.

The latest group, Let America Vote, made a five-figure digital ad buy in the Granite State at the end of March targeting Sen. Kevin Avard, R-Nashua, to change his vote on Senate Bill 3.

Senate Bill 3 was introduced by Sen. Regina Birdsell, R-Hampstead, to address concerns that due to New Hampshire’s “lax” voting laws, people who aren’t living in the state, or are only temporarily here, are voting in New Hampshire elections. Republicans want to tighten the process, but Democrats have dubbed the bill as a form of voter suppression. The Senate passed the bill on March 30 on a party line vote, 14-9, with Avard voting for the legislation.

The bill tackles the complex issue of “domicile” versus “residence.” Under current laws, the definition of domicile is “that place, to which upon temporary absence, a person has the intention of returning.” Republicans think that’s vague and want to make clear who can and cannot vote in the state.

Democrats are pushing the narrative that the bill would prevent college students and military members who are “temporarily” in the state from voting in elections when it’s their right to cast their ballot. That’s the message Let America Vote wants residents to hear, so they can encourage their lawmakers from moving the bill forward.

Republican lawmakers and New Hampshire Republican Party Chairman Jeanie Forrester are pushing back, saying it will not stop college students or military members from voting.

Let America Vote is a new group that formed in February 2017 under the leadership of Jason Kander. The former Democratic Senate candidate gave Republican U.S. Sen. Roy Blunt a run for his money in the Missouri Senate race, which was one of the most watched races in the country. Blunt beat Kander — 49.2 to 46.4 percent.

Kander didn’t stay quiet after losing the election, though. With his new organization, he focuses on states that are trying to suppress voting rights.

Let America Vote recently announced they were launching three new voting rights ads in Georgia’s 6th Congressional District special election, in Virginia to oppose a Republican plan to overturn Democratic Gov. Terry McAuliffe’s veto of a bill that would require a photo copy of a state-issued ID included with absentee ballots, and in New Hampshire to oppose SB 3, “which could strip voting rights from college students and would allow elections officers to visit people’s homes to check in on residents just because they voted.”

Kander penned an op-ed for The Nashua Telegraph on Sunday, writing that Republicans are trying to suppress Democratic voters so they can win in future elections.

“For decades, some Republicans across the country have gotten away with passing deliberate voter suppression laws by rebranding them as efforts to fight against voter fraud,” he wrote. “There is more to this agenda than simply suppressing the vote. Not coincidentally, Republicans are pushing this bill just months after New Hampshire Democrats won both a U.S. Senate seat and the presidential vote in the 2016 election. Senate Bill 3 will tip the scales against Democrats where they’ve have won by razor-thin margins.”

Yet, it’s been noted by several right-wing bloggers and members of State House press corp that progressive outside groups seem to be very interested in this bill. New Hampshire Democrats often decry when outside money for Republicans pour into the state, but now, they have publicly applauded these groups focused on voting rights.

Priorities USA, a pro-Democratic group, launched digital ads earlier in March targeting Republican senators on the Election Law Committee to defeat the bill before it went to the Senate.

The ads targeted Sen. James Gray, R-Rochester and Sen. Andy Sanborn, R-Bedford, both cosponsors of the bill, and Birdsell, author of the bill and chair of the committee.

“Hmmm — liberal Democrats from outside New Hampshire trying to influence the outcome of our democratic process. Sounds familiar,” said NHGOP senior adviser Patrick Hynes to WMUR when Priorities USA launched their ads.

Priorities USA is known nationally for its focus on voting rights. The fundraising arm of the organization, Priorities USA Action, was the top super PAC supporting Democratic president candidate Hillary Clinton in 2016 and was the main money driver for former President Barack Obama’s 2012 campaign.

The group also said it urged voters to call N.H. House Speaker Shawn Jasper’s office about voting rights.

The bill now moves to the House Election Law Committee, which will hear public testimony again before the bill moves on to the full House for a vote. It can be expected that these outside groups, and possibly others, will also continue their campaign to kill the bill.

NHGOP, Conservative Group Blast Hassan After Meeting With Supreme Court Nominee

U.S. Sen. Maggie Hassan met with Supreme Court nominee Judge Neil Gorsuch on Monday to discuss issues important to the freshman senator from New Hampshire. Republicans were quick to criticize her statement about the meeting, saying it’s riddled with hypocrisies and calling on her to support a full Senate hearing for Gorsuch.

“I appreciated the opportunity to meet with Judge Gorsuch and to discuss the importance of a strong and independent judiciary,” Hassan said in a statement after the meeting. “In our conversation, I highlighted the critical role the judicial branch plays in protecting the civil rights of all Americans, including a woman’s constitutionally protected right to make her own health decisions. I also emphasized the importance of ensuring equality for LGBTQ individuals, as well as my concerns with the influence of unlimited corporate and dark money in American politics. I will continue to thoroughly vet Judge Gorsuch’s record and views throughout the hearing process.”

Hassan and her Democratic colleague, Sen. Jeanne Shaheen, have expressed concerns about Gorsuch, but have also called for a full confirmation hearing and vote by the Senate.

“It is not in our interest to deny a hearing to Neil Gorsuch,” Shaheen said at a Friday town hall. “That’s what’s prescribed under the Constitution. Let me tell you something. I’m not going to go out and say it’s wrong for them and then say that it’s right for us.”

Last year, the GOP Senate leadership refused to hold a hearing or vote for former President Barack Obama’s nominee, Merrick Garland. There has been some discussion among Senate Democrats who want to filibuster or block Trump’s nominee, similar to what Republicans did to Garland. The GOP has been calling for an “up-or-down” vote on Gorsuch, meaning a direct “yay” or “nay” vote on him without any obstruction.

Hassan and Shaheen have not made a final decision on how they will vote for Gorsuch. His confirmation will require 60 votes, or a cloture vote, according to Senate Minority Leader Chuck Schumer.

“I think it is absolutely appropriate and right for us to do our constitutional duty and have a hearing,” Hassan said.

New Hampshire Republican Party Chairman Jeanie Forrester is going to hold Hassan to her promise, noting that last year, the former governor called for a hearing and confirmation vote for Garland.

“If she doesn’t call for an immediate hearing and vote on Judge Gorsuch, she will be in direct contradiction of her past statements,” Forrester said.

Hassan penned an op-ed in the New Hampshire Union Leader in February 2016, calling on the Senate to hold a hearing and vote to fill the Supreme Court vacancy left by the death of Justice Antonin Scalia

“As is often said, justice delayed is justice denied. A stalled Supreme Court will not move our country forward; it will only exacerbate the deep political divide and gridlock in Washington,” Hassan wrote.

America Rising Squared (AR2), an arm of the Republican opposition research group America Rising, is also pushing for Hassan to call for an up-or-down vote for Gorsuch.

“After spending nearly a year talking about the importance of having a ninth justice on the Supreme Court, Senator Hassan should join Senator Shaheen in calling for an ‘up-or-down’ vote for Judge Gorsuch,” said Nathan Brand, spokesman for AR2, in a statement to NH Journal. “If she instead joins in Senator Schumer’s obstructionist games, it reaffirms her hypocrisy and the fact that she puts her partisan agenda before the interest of Granite Staters.”

There was some confusion earlier this month on Shaheen’s comments about calling for an up-or-down vote. On the Senate floor, she surprised many people when she said on February 7 that she would support an up-or-down vote, going against what Schumer wants. Shaheen met with Gorsuch on February 15.

“Unlike the Republican majority, I haven’t heard any Democrats saying we don’t think that Judge Gorsuch should get a hearing or that he should get an up-or-down vote,” she said. “Everybody I’ve talked to agrees he should get a hearing and an up-or-down vote.”

However, Ryan Nickel, Shaheen’s communications director, took to Twitter to correct the record saying she meant a cloture vote, or 60 “yeas” to be approved.

Ar2 also criticized Hassan’s statement, specifically when she said she has “concerns with the influence of unlimited corporate and dark money in American politics.”

The New Hampshire Senate race between Hassan and former GOP Sen. Kelly Ayotte was the second most expensive race in the country, with more than $90 million spent in outside funding. Only the Pennsylvania Senate race topped it with more than $119 million in outside spending.

Hassan and Ayotte had the opportunity to avoid big spending by outside groups in the race, but a pledge failed to come to fruition.

Ayotte proposed a “People’s Pledge” similar to one adopted in Massachusetts in the 2012 race between Sen. Scott Brown and Sen. Elizabeth Warren — requiring that a candidate who benefits from a third party ad donate 50 percent of the ad’s total cost to a charity of the other candidate’s choice.

Hassan countered Ayotte, declining to sign the pledge and suggesting limiting each candidate’s spending to $15 million. “This move is politician speak for ‘I do not want to sign the People’s Pledge,’” Ayotte said. The candidates could not come to an agreement and the outside group money flooded into the state.

The Center for Responsive Politics wrote an article about the staggering amount of dark money in the New Hampshire Senate race titled, “Dems in New Hampshire supported by the secret money they rail against nationally.” The article exposed the issue of Democratic candidates being against dark money and outside spending, yet letting it happen anyway.

“If hypocrisy is the coin of the realm in politics, then spending by a Democratic dark money group in New Hampshire’s Senate race could be Exhibit A,” the article stated. “For years, Democrats have blasted Republicans’ use of unlimited secret money in elections. There’s one problem: Hassan herself is receiving millions of dollars in ground support…” from outside groups.

More outside money was spent against Republicans in the New Hampshire Senate race. Nearly $45 million was funneled to the Granite State opposing Ayotte, while $34.8 million went against Hassan.

Gorsuch is making the rounds through the Senate, led by Ayotte, who is helping President Donald Trump’s nominee through the confirmation process. The Senate Judiciary Committee’s confirmation hearings are scheduled to begin on March 20.

Why Did Right-to-Work Fail Again in New Hampshire?

Yet again, the House voted Thursday to kill a right-to-work bill. Since the early 1980s, the New Hampshire House has rejected right to work 35 times and despite Republican control of the State House, they still couldn’t get it done this year.

The bill, which would have prevented unions from requiring nonmembers to pay the cost of representing them, failed by a 200-177 vote, with 32 Republicans joining every Democrat to oppose the bill. Fifteen Republicans and four Democrats did not vote. After the bill was voted down, the House brought up a measure, which passed, stating the right-to-work issue could not be brought up again until the next legislative session in 2019.

So why did it fail again? The Democrats argue that right-to-work is union busting, creates a “free rider” problem, and is wrong for the Granite State. If it had passed, New Hampshire would have been the first state in the northeast to have a right-to-work law on the books. However, the politics of the vote reveals confrontational rhetoric, deep wounds within the Republican Party, and the blame game of who’s at fault for letting it fail.

 

“STRONG-ARMING” VOTES

Gov. Chris Sununu made it clear throughout his campaign that he wanted to see right-to-work pass in New Hampshire. He even mentioned it in his inauguration speech in January, saying how the law would be an important economic benefit for the state and would encourage businesses to come here.

Before the vote, the governor said he was not “banging the walls” trying to get House Republicans to vote a certain way. However, behind closed doors, he reportedly told the House Republican caucus on Thursday that “you’re either with us or against us.”

“You’re either a Republican or a Democrat,” and he invited opponents of right-to-work to “go leave and vote with the Democrats.”

High-ranking supporters of the bill also told lawmakers that if they won’t vote in favor of the bill, then figure out a way not to vote against, meaning stay home or abstain.

Rep. Matthew Scruton, R-Rochester, said he was encouraged by his colleagues to stay home because “the roads were slick.”

“I did not listen to that advice,” he told the Fosters Daily Democrat. “This bill was being pushed by several out-of-state special interest groups and was not going to help New Hampshire workers.”

State Republican Party Chairman Jeanie Forrester also displayed some of her strength in her newly elected position at a Wednesday press conference, where she said “for those folks who support the governor,” they will be rewarded in the next election cycle with campaign funds.

Even for outside groups, like the state chapter of Americans for Prosperity, said they wouldn’t support lawmakers who broke their pledge. During each election, the group asks all legislators to sign a five-part pledge, which includes support for right-to-work.

Reps. David Miltz, of Derry, and Rio Tilton, of Seabrook, signed the pledge, but voted against the bill Thursday.

“Have I mentioned that we don’t treat pledge breakers well,” AFP state director Greg Moore told the Union Leader. “If we don’t do something when you break a pledge, the pledge doesn’t mean a whole lot, right?”

This pressure from House leadership, the governor’s office, state party, and outside groups might not have convinced “on-the fence” Republicans who are current or former union members, or know people who are in a union. Rep. Tim Josephson, D-Canaan, said strong-arming the House Republican caucus into voting in favor of something they don’t agree with alienates them.

For some lawmakers, they are concerned about how their vote might play in their home district come election time next year or if they choose to run for local office.

That happened to House Speaker Shawn Jasper in 2012. He lost an election to serve as Hudson selectman, even though he served on the board for years and was the incumbent chair. He blamed his loss on his support for right to work, which failed by one vote in the House in 2011.

 

THE JASPER BLAME GAME

Jasper’s role in the vote is also being questioned by the more zealous right-to-work lawmakers. Some say he didn’t try hard enough to convince people to vote for it and are blaming him for the bill’s failure. Jasper is pushing back saying that’s not true, he supports right-to-work, but it was always going to be a tough sell in the House. Jasper was also endorsed this past election by the SEIU Local 1984, State Employees Association. That endorsement probably didn’t help his cause either.

The speaker barely won his gavel for a second term after defeating a fervent right-to-work supporter in Rep. Laurie Sanborn, R-Bedford. After the December vote, Jasper said he recognized that his party was fractured, but he hoped to move forward and work with all Republicans.

“I think we’d all like to move beyond the issues of the past,” he told reporters at the time. “I’m certainly going to be working with the people who were not in favor of me being re-elected.”

To prove he stood with the governor, Jasper stepped down from the speaker’s podium, went to his seat, and cast a vote in favor of right-to-work. After the vote, he echoed a similar message as he did in December.

“What I’m trying to do, and not everyone appreciates this, is to avoid tearing my caucus apart,” he said.

Despite his sentiments, some Republicans still think his support his disingenuous. Some say he “stacked” the House Labor, Industrial and Rehabilitative Services Committee with anti-right-to-work Republicans.

“There has been an ongoing attempt by a number of Right-to-Work supporters, who facing the possibility that SB 11 will be defeated in the House on Thursday, are attempting to portray me as the reason for such a defeat, alleging that I had ‘stacked’ the Labor Committee,” Jasper said in an email to House Republicans on Wednesday before the vote. “Nothing could be further from the truth.”

At the press conference with Forrester, Jasper pushed back against making right-to-work a “litmus test.”

“I’ve said all along that this is a difficult issue,” he said. “I don’t think this is an issue that should define a good Republican versus a bad Republican. I would not characterize anyone who votes against this as a bad Republican.”

Jasper was then criticized by former NHGOP Chairman Jennifer Horn on Facebook, saying he sent “a clear and consistent message against this legislation.”

“Speaker Jasper has failed the governor and he has failed our party,” she said. “Worst of all, he has failed New Hampshire.

Jasper quickly shot back, saying “her comments shows a lack of understanding of the legislative process and a lack of understanding of the individuality of House members. Republicans are not just mind-numbed robots who do what they are told.”

 

LACK OF UNIFIED CAUCUS OR MESSAGE

Jasper is right in that the New Hampshire Republican Party is fractured and this right-to-work bill further exposed the wounds that have yet to be bandaged. Among the 32 Republicans who voted against the legislation, several of them were from Jasper’s leadership team.

Twenty of the 32 Republicans were from Rockingham County and out of 10 representatives from Derry’s delegation, seven of them opposed it.

The vote also split former allies, including President Donald Trump supporters. Rep. Fred Doucette, R-Salem, a former co-chair of Trump’s campaign and a member of the labor committee, voted against right-to-work. Doucette is also a former union member and said many of his constituents are also union members.

Rep. Al Baldasaro, R-Londonderry, chair of Trump’s state campaign veterans’ coalition, supported the bill, saying “union members in the Republican Party failed us.”

House Democratic Leader Steve Shurtleff told WMUR that the GOP leadership “is trying to paint it as being Democrat versus Republican, but it is bipartisan. I don’t think it plays well to tell Republicans who disagree with this that they will be ostracized by the party going forward. I’ve always told my caucus they are free to vote their consciences.”

It remains to be seen how Jasper and the House leadership plan to unify the Republican caucus, but if another controversial vote comes up, expect to see some divide in the party again.

Rep. Sean Morrison, R-Epping, also voted against the bill and said the right-to-work fight was more of “a matter of message than substance.”

“I too believe this is about freedom … freedom of businesses to conduct themselves as they see fit, and freedom from overreach by government in private business matters,” he told the Union Leader. So let’s lower energy costs, lower business taxes, less red tape and less government interference in employee/employer relationships, as we should in the Live Free or Die state.”

Sununu said he was “deeply disappointed” in the result of the vote, but isn’t going to let this failure define his term.

“It is clear that some House members did not understand this opportunity to unleash the untapped potential of our economy,” he said in a statement. “I know that we can continue to work collaboratively on initiatives that will drive new business into the state. Right-to-work, though important, is just one piece of a broader effort to promote economic development, signaling to our nation’s business community that New Hampshire is open for business.”

 

WHAT COMES NEXT?

Expect to see a push on further cutting business taxes in the state. Former state Rep. Joe Sweeney also hopes that becomes a focus of the administration.

There’s also a national right-to-work bill that has been introduced in Congress. If that passes and Trump signs it, New Hampshire will have to comply with it. It has a possibility of making it through, since Republicans hold majorities in the House and Senate, but it’s almost certain that Democrats would filibuster the bill if it reaches the Senate floor.

It’ll also be important to keep an eye on the 32 House Republicans that voted against right-to-work next year if they seek reelection. Will the NHGOP find someone to challenge those representatives in a primary fight? Will they see any funds from the party for reelection?

However, don’t expect right-to-work to be gone for good. If the GOP can hold on to the State House in 2018, it can push the legislation again.

“It’s always been a heavy lift,” Moore told the Union Leader. “This cause can succeed but only if you make it a prolonged message which galvanizes the support for free enterprise that is out there across this state. We’re bowed but not beaten.”
