NH House Republicans May Have Enough Votes to Pass State Budget With Conservative Approval

After weeks of uncertainty and negotiations, it appears the Republican-controlled legislature could have enough votes to get the state budget passed Thursday, after key conservative groups indicated they intend to vote in favor of the spending plan.

Both the House and Senate are voting on an $11.7 billion, two-year spending plan negotiated by a committee of conference earlier this month. The Senate is expected to approve the compromise, but its fate is less certain in the House.

Gov. Chris Sununu, NHGOP Chair Jeanie Forrester, and House Speaker Shawn Jasper have been quietly making the rounds to appeal to the conservative caucuses in the New Hampshire House. The House Republican Alliance and House Freedom Caucus had concerns about increasing spending over the previous biennium. GOP leadership appears to have quelled those worries after business tax cuts were approved in the final version of the state budget during the conference committee between the House and the Senate.

No members from the two conservative blocs sat on the budget conference committee, which also harbored some bitter sentiments from representatives.

“While the caucus as a whole, finds the level of spending objectionable, we were able, with the cooperation of the Senate, to craft a bill that will have some positive outcomes for New Hampshire taxpayers, and businesses,” said Rep. Anne Copp, R-Danbury. “Many of these points were clear objectives for the [Freedom Caucus] when we went to House leadership in the early stages of the budget process. It is unfortunate that some of House leadership chose to exclude us from the process.”

At first, it was unclear if House GOP leadership would choose to work with the Democrats or conservatives to get a budget passed in the chamber. After anti-abortion language was added to the bill in the conference committee, Democrats said they would oppose the budget.

“What businesses need, with one of the lowest unemployment rates in the country, is a well-qualified workforce, to maintain our quality of life in the Granite State and a sound infrastructure. It isn’t a tax cut,” said House Minority Leader Steve Shurtleff at a Wednesday press conference with more than 30 other Democratic lawmakers.

With their entire caucus planning to vote against the budget, House Republicans cannot afford to lose more than 25 to 30 votes within their own party, depending on how many of the 400 representatives show up to vote.

The conservatives led the defeat of the House’s original budget proposal in April, after 32 Republicans joined Democrats to vote against the plan. It was the first time since at least 1969, when records were first kept, that the House failed to produce a budget to pass on to the Senate.

Despite several conservative endorsements on the final version of the budget, they are not giving the credit to Jasper. The speaker and conservatives have not exactly seen eye-to-eye on many issues this legislative session. Some even blamed him for not getting a budget passed in April because Jasper didn’t give in to their demands. For the budget that came out of the conference committee, some conservatives attributed their change in position due to the governor and Senate leadership.

“The Freedom Caucus cannot thank the Governor and Senate Leadership enough for the work they have done to deliver a budget that is more fiscally responsible, often having to fight House leadership to lower spending and reduce taxes,” said Rep. John Burt, R-Goffstown. “There can be no doubt that it is a bizarre situation when the Senate President and Senate Finance Chair have to work to bring the House Republican caucus together, but that is precisely what happened, and this budget undoubtedly would have collapsed without their efforts.”

Senate Finance Chair Gary Daniels, R-Milford, said he was pleased to hear that members of the House Republican Alliance and House Freedom Caucus would vote for the budget.

“It was important to the process to have input from these legislators regarding elements they felt needed to be included in the proposed budget, and their interaction helped shape the final product,” he said. “What we achieved is a budget that is good for New Hampshire and provides resources for a strong economic future by balancing key priorities, providing personal and business tax relief and growing the state’s rainy day fund, while keeping overall state spending within responsible levels.”

There are still some conservatives that plan to vote against the budget, but whip counts total defections at no more than 25 members. Still, it’s expected to be a close vote and Sununu was optimistic, yet cautious.

“You never get anything by raising your voice and threatening,” he told New Hampshire Public Radio. “No, open positive listening. And when you bringing people in and talking to them and you are opening, and listening, it’s amazing what you can get done.”

Democrats Fight Against Voting Reform, Fetal Homicide Bills Come Up Short in N.H. House

It wasn’t a good day for Democrats in the New Hampshire House. Lawmakers who were opposed to bills like election law reform and fetal homicide legislation saw that their efforts were futile in convincing a Republican-led chamber to defeat them.

Thursday marked the final deadline for the House to act on legislation that originated in the Senate before conference committees are set up on bills to reconcile any differences between the two chambers. Naturally, some of the most controversial bills were saved for this day and most of them passed the House despite protests and hard campaigning from Democrats.

The House passed Senate Bill 3, a bill tightening the identification requirements for people registering to vote, by a 191-162 vote. Only two Democrats voted for the bill and nine Republicans opposed it.

“I commend the support of the House in strengthening the residency requirements for voters in New Hampshire as there is nothing more sacred as a citizen of this state and this nation than the right to cast a ballot in a free and open election,” said bill sponsor Sen. Regina Birdsell, R-Hampstead. “This legislation does nothing more than ask a resident to provide proof that they live where they say they do and provides an additional layer of protections increasing the integrity of elections in the state of New Hampshire.”

This was one of the most hotly debated bills of the legislative session. Proponents say it closes a “domicile loophole” where people are allowed to vote in the state without being required to prove it. Opponents believe it’s a GOP bill to suppress voters, especially young people.

“Today’s vote in support of SB 3 was a partisan sabotage of the election process that will do nothing but confuse and intimidate new voters,” said House Minority Leader Steve Shurtleff. “This legislation adds over 350 words to the registration form that new voters will be required to read, and swear to understand, with the pressure of a growing line behind them at the polls on Election Day.”

The bill heads back to the Senate, which is expected to concur with small changes made by the House. If they approve of it, the bill will go to Gov. Chris Sununu’s desk where he is expected to sign it into law.

Democrats accused that the bill further perpetuates President Donald Trump’s claims that there is rampant voter fraud in the United States.

“This legislation was clearly designed to placate those who buy into President Trump’s discredited assertion that fraud cost him the popular vote in New Hampshire,” Shurtleff said. “Leaders from both parties denounced those assertions, and as we know from the reports released following every single New Hampshire election, voter fraud is not an issue in our state.”

SB 3 also has the backing of Secretary of State William Gardner, a Democrat. He said he doesn’t believe the bill places undue burdens on any voter. He was recently asked to sit on Trump’s voter fraud commission.

The bill also garnered interest from outside groups that spent money in the state to convince residents to contact their legislator to oppose the bill.

“As host of the first-in-the-nation primary, New Hampshire has the obligation to ensure our system is beyond reproach,” Sununu said in a statement. “This bill does exactly that and as such, I support SB 3 and commend the House of Representatives for their actions today.”

Democrats were also not happy about the passage of Senate Bill 66, legislation that defines a fetus at 20 weeks and beyond as a person for purposes of criminal prosecution of murder or other violent crimes.It contains an exemption for abortion. The bill passed 186-170.

Democrats tried several times during the session to table the bill, but those attempts failed. The bill was originally retained in the House Criminal Justice Committee a couple weeks again and lawmakers expected to work on it over the next few months. In a surprise move last week, Republicans reconsidered the bill and voted it ought to pass to the full House.

“Today, the House of Representatives passed a critical fix that allows prosecution of individuals who criminally end the life of a viable unborn baby,” Sununu said. “It provides security and addresses injustice for women who may have been in abusive situations that resulted in the death of a fetus.”

The bill will also go back to the Senate to concur on a House amendment and then on to Sununu’s desk, if approved.

There was a bright spot for Democrats when the House overwhelmingly passed Senate Bill 191 to fund full-day kindergarten in the state. The final vote was 231 to 100.

Approximately $1,100 per pupil would be sent to school districts for the program with the funds coming through revenues from Keno, the electronic bingo game, which is currently illegal in New Hampshire.

“The House of Representatives deserves high praise for moving full-day kindergarten forward and recognizing that this is a priority for many families in both considering the quality of a community’s public education and in their decision-making process when choosing a place to raise their children,” Sununu said.

The bill heads back to the Senate, which has historically rejected Keno. Democrats blasted the Senate budget for not funding full-day kindergarten in its proposal, but it’s not clear if tying Keno revenues to the program will deter it in the Senate.

“This bill is a long-overdue recognition of those benefits, and a signal to working families and the business community that we understand our obligation to offer all New Hampshire children the opportunity for a high quality education,” Shurtleff said. “Support of full day public kindergarten is a top priority for House Democrats, and I am pleased that the Republican majority has joined us in recognizing the benefit of this investment.”

What’s Happening With the N.H. House Democratic Caucus?

For the third time this legislative session, a House Democrat switched party affiliation in New Hampshire, highlighting that Democrats are also struggling to remain unified in Concord. It’s been well-documented that House Republicans still have deep wounds from the 2016 election, with two conservative caucuses that have caused trouble for GOP leadership. However, with three lawmakers jumping ship from the party, there are some internal conflicts happening within the Democratic caucus.

In total, four lawmakers have changed their party affiliation since the November election. Two Democrats left the party to join the Republican Party and a third left for the Libertarian Party of New Hampshire (LPNH). The fourth representative left the Republican Party for the LPNH.

Rep. Joseph Stallcop of Keene was the latest House members on Wednesday to switch his party affiliation. He switched from the Democratic Party to the LPNH.

“Personally witnessing the situation at Standing Rock showed me the danger of relinquishing power and authority into an institution, while my time in Concord reinforced the ineptitude that can exist by those in charge,” he said. “I originally joined the Democratic Party in hopes of making a difference through critical thinking and my classical liberal viewpoint, yet with the lack of unbiased data in caucuses as well as backlash on votes I’ve independently made, it seems there is no longer a place for me here.”

LPNH is having a banner year since the November elections. Another lawmaker, Rep. Caleb Dwyer of Pelham switched from the Republican Party to the LPNH in February. The party also garnered enough of the votes in the gubernatorial race to give them official ballot access in 2018.

Max Abramson ran as the Libertarian candidate in 2016, against now-Gov. Chris Sununu and Democratic nominee Colin Van Ostern. He received 4 percent of the vote, the required amount to gain ballot access.

It’s the first time in 20 years that the LPNH had ballot access. When they last had it in the 1990s, the party had four members in the Legislature. Then in 1997, ballot access laws changed to increase the vote threshold needed for a party to retain ballot access from 3 percent to 4 percent.

LPNH Chairman Darryl W. Perry called Stallcop’s switch a “historic day” since it’s the first time in two decades that they have a Libertarian caucus.

Rep. Mariellen MacKay of Nashua changed her Democratic affiliation to Republican in April and Rep. Robert Theberge of Berlin also changed from Democrat to Republican right after the November election.

So now, the House membership is 221 Republicans, 170 Democrats, and two Libertarians. There are six vacancies due to death, resignation, or appointment to a position in Sununu’s administration. One representative has not been officially sworn in yet.

In a House with 400 members, one would think that party changes are pretty common. That’s actually not the case in New Hampshire, or even nationally. According to Ballotpedia, there have only been 79 current legislators in State Houses across the United States who have switched parties since 2007. One of the last people to switch parties in New Hampshire was Sen. Lou D’Allesandro of Manchester. After serving two years as a Republican in the House, in 1998 he ran as a Democrat for the Senate where he still holds a seat and is still a Democrat.

Jumping on the chance to criticize the Democratic Party for losing members, NHGOP Chair Jeanie Forrester blasted out a statement once the news came out on Wednesday that Stallcop was leaving the party.

“Would the last one in the New Hampshire Democrat Party please turn out the lights? Yet another former Democrat has concluded that the party of big government and obstruction is no longer worth being a member of,” she said. “Meanwhile, a significant majority of Granite Staters approve of the job Republican Gov. Chris Sununu is doing in the Corner Office. That’s because working families know that from improving education to investing in infrastructure to strengthening the economy, Republicans are working hard to improve the quality of life for Granite Staters every day.”

House Minority Leader Steve Shurtleff said people shouldn’t read much into three people leaving his caucus.

“It’s just kind of a shakeout,” he told the New Hampshire Union Leader.

However, other Democratic representatives are saying there is a lot of “dissatisfaction” in the caucus.

“Most Democrats would think with the controversy around Trump, we might gain some Republicans, more moderates, and yet we are losing Democrats,” said Rep. Peter Leishman, D-Peterborough.

The current dynamics of the New Hampshire Democratic Party often mirror the national party on what its role should be in GOP-led politics. For the first time in nearly a decade, Democrats are fully the minority party. The U.S. Congress is Republican-run and the White House has a Republican president. The same is true in New Hampshire where Democrats are in the minority of a GOP-legislature and the first Republican governor in 12 years.

The problem is that there are differences of opinion between Democratic lawmakers on what their role is in the New Hampshire House. They’re trying to figure out how to navigate their position and get their legislative priorities passed.

At the national level, many Democrats have been adopting the “resistance” mindset by voting against any GOP bill or watching Republicans fight amongst themselves, as exhibited during the health care debate.

So far, New Hampshire House Democrats have been largely sitting back and watching Republican Party infighting derail the GOP’s own political agenda. Yet, some Democrats want the party to push back more against the Republicans.

This conflict was on full display during the chaotic budget debate in April. After the House failed to pass a budget on the first day due to conservatives voting against it, some Democrats were willing to work with Republican leadership to get something passed. Two Democrats took to the House floor to encourage its caucus to vote for the state budget rider, which was in direct opposition to what Shurtleff told them to do. In the end, 14 Democrats voted in favor of the bill to get a budget passed, but it failed 169-177.

While their party disagreements aren’t as noticeable as the Republicans, its crucial that there is unity within the caucus if they want to block future GOP bills, like they did with right-to-work earlier this year. It’s also important when it comes time to craft a message for elections next year.

One of their next big tests will be in June when the final state spending plan comes back to the House. If conservatives still vote against the budget, House Speaker Shawn Jasper might need to ask them for support. What they do in that moment could set the tone for 2018.

Two Major Issues Democrats Have With Gov. Sununu’s Budget

After Gov. Chris Sununu released his $12.1 billion biennium budget on Thursday, the overall sentiment among Democrats and Republicans was “the devil is in the details.”

Those details will be hammered out in the next few months as the House and Senate make their recommendations to Sununu’s 2018-2019 budget. Overall it appears both parties believe it’s a solid budget with room for improvement. Republicans praised it for being “a realistic, conservative budget which is transparent, forward thinking and strengthens education, supports our cities and towns and focuses on solving real problems that have plagued taxpayers for years,” according to Senate leadership.

Democrats were glad that Sununu kept some of his campaign promises, but were also critical that he didn’t provide too many details on proposals they deemed important, including Medicaid expansion and full-day kindergarten.

“I am very concerned about the $500 million cut from state agency budget requests and what that could mean to the citizens of New Hampshire,” House Minority Leader Steve Shurtleff said in a statement. “The governor’s budget address made no mention of the successful NH Health Protection Program, leaving serious unanswered questions for the 50,000 Granite Staters who rely on the program for their health care coverage.”

In his budget proposal, Sununu includes more than $50 million in spending to address an existing shortfall in the Department of Health and Human Services’ (DHHS) fiscal 2017 budget.

In January, DHHS projected a $65.9 million dollar budget shortfall. Commissioner Jeffrey Meyers pushed back against the accusation his department overspent, claiming instead Medicaid costs did not decline as the legislature expected during the last budget debate. That put Sununu in the awkward position of writing a budget with an unexpected hole in it, while also figuring out how to handle Medicaid for the state.

As for the deficit, Sununu is requiring the commissioner to make quarterly reports to him and members of the legislature leadership “about where we actually stand on our true costs, so we can become a more nimble government that’s responsive, not just reactive.”

“As governor, I won’t make people wait until after an election to discover we may have a shortfall,” he said in remarks during a Thursday joint legislative session. “We have to be transparent. We have to be honest with the people and honest with ourselves.”

Democrats’ claim he didn’t mention Medicaid expansion is true. He only mentioned the program when talking about the DHHS deficit, since that’s where the department says its money went.

“And where we have failed in the past, I am pushing for true accounting of our Medicaid program so we can reconcile estimated Medicaid payments to actual costs,” Sununu said. “And as we go forward, be sure that we won’t wait two years to check in on them again.”

He doesn’t say if he plans to expand, repeal, or replace NH Health Protection Program. The Medicaid program in New Hampshire received bipartisan support in the legislature last year when lawmakers extended the program until Dec. 31, 2018.

That legislation gives Sununu wiggle room as he attempts to balance politics and health coverage for the state. As Washington debates repealing the Affordable Care Act, several states including New Hampshire are waiting to see how Congress and President Donald Trump’s administration handles the issue.

Sununu was reluctant to say anything about Medicaid on the campaign trail, commenting he was worried about financing the program in the long-term, but didn’t mention repeal. Not wanting to permanently fund the program, he told voters it was better to let the federal government make the first move.

Before the budget speech, Democrats waited to see if Sununu would fulfill his campaign promise of funding full-day kindergarten. His proposal includes $9 million a year for full-day kindergarten, but after the speech Democrats sought clarity on determining which communities get funding.

Sununu said funds, which will be awarded in addition to education adequacy grants, would target the communities that need it most based on a community’s property wealth, the number of students on subsidized lunch programs, and communities with a high number of English as a second language students.

“So I am proud today to be the first governor to deliver a real full-day kindergarten program for communities across the state,” he added.

There’s a big distinction to be made with the state “mandating” full-day kindergarten and simply funding full-day kindergarten. Several Democrats sought to require school districts to offer full-day kindergarten, but Sununu’s budget doesn’t make that a requirement. He’s leaving it up to the individual cities and towns, but they’ll receive more funds if they opt-in.

In towns that vote to implement full-day kindergarten, school districts presently only receive 50 percent of the state’s per-pupil grant for kindergarten students. Under Sununu’s plan, the neediest communities can apply for additional grants to make the program possible.

Rep. Victoria Sullivan, R-Manchester, who sits on the House Education Committee, said she wasn’t thrilled about Sununu’s full-day kindergarten funding proposal. Sullivan said it should be a local community’s decision, and could eventually lead to mandated full-day kindergarten.

House Speaker Shawn Jasper told reporters Sununu’s full-day kindergarten proposal probably won’t be included in the House version of the budget.

“I think that is going to be a stretch,” he said. “I think if you looked around the hall, you probably didn’t see a lot of enthusiasm on the part of Republicans on that issue. We’ll have different priorities in some areas than the governor has, certainly. I don’t think there’s ever been a budget that’s gone into the House and come out looking the same way, but he’s given us a great starting point.”

The two-year budget must be passed by June 30 to go into effect on July 1 of the next fiscal year. The House Finance Committee will look at Sununu’s budget before making a recommendation to the full House. After the House passes its version of a budget, it goes to the Senate Finance Committee, which will recommend its own proposals to the full Senate, before going to the governor’s desk for his signature or veto in spring.
