The Winners and Losers of the New Hampshire Legislative Session

It felt like the last day of school at the New Hampshire State House on June 22. Lawmakers were signing each other’s session books (the political version of yearbooks), shaking hands, and taking pictures together. It had been another eventful legislative session that saw many highs and lows for Gov. Chris Sununu, the first Republican in the corner office in 12 years.

The Republicans didn’t always get along during this legislative session. Remember the defeat of right-to-work legislation and the House failing to pass their own version of a budget earlier this year? Despite the varied ideological depth of the New Hampshire Republican Party, they were able to show they can work together and give Sununu some final wins at the end of the first year of the 165th General Court, including full-day kindergarten and a budget getting passed.

Now, the lawmakers head home for the summer months and it’s time to decide the winners and losers of the session:

 

WINNERS:

Gov. Chris Sununu: As much as Democrats wanted Sununu to not do well his first term in office, several of his campaign promises and policy priorities made their way through the legislature and became law. One of his first wins in office came from the repeal of a license requirement for concealed carry firearms. It was something he said he would do on the campaign trail, and it got done within the first two months of his term.

That’s not to say that Sununu didn’t have some setbacks during the legislative session. The governor, who didn’t have prior legislative experience before taking office, saw the defeat of right-to-work under his watch and the House failed to pass a budget for the first time in recent memory. Some critics claim Sununu could have done more to get right-to-work passed, but the Republican infighting revealed a divided party that would prove difficult for GOP leadership to navigate.

With the budget, Democrats attempted to paint Sununu as not in control of his own party, but Sununu actually stood as the most to gain from the House’s failure. The House cut several of Sununu’s budget priorities in its version, but when the Senate drafted its own budget, it used Sununu’s proposal as a guide. What was ultimately passed at the end of June was a compromise of House, Senate, and Sununu’s priorities.

On the final day of the session, Sununu also saw the passage of full-day kindergarten and a key school choice bill. It might not have been a perfect process, but the governor saw several items from his policy wish-list reach his desk.

 

Marijuana: For several years, New Hampshire has been the only state in New England that still criminalized possession of small amounts of marijuana. For many lawmakers, they saw a connection between the rampant opioid crisis and marijuana being used as a potential gateway drug. Historically, the Senate has voted down various bills relating to looser pot laws, but advocates fought long and hard to see marijuana decriminalization passed. After compromising with the House on an amount, the Senate finally found a bill that it could handle.

In June, the legislature decriminalized three-quarters of an ounce of pot and Sununu signed it into law. Marijuana advocates applauded lawmakers for taking the first step, although they are continuing to work toward full legalization.

 

Libertarians: The Libertarian Party of New Hampshire had a banner election year in 2016. It obtained 4 percent of the vote in the gubernatorial election to qualify for the ballot in 2018. It also had three sitting lawmakers switch their party affiliations from Democrat or Republican to Libertarian. The last time the Libertarian Party had an official caucus in the State House was in the 1990s when it had four members.

While Libertarians haven’t been the deciding votes on any controversial bills during the session, it is clear that some members of the major parties are unhappy within their own caucuses. The Libertarian Party needs to garner 4 percent of the vote again in 2018 to remain on the ballot, but with political partisanship at an all time high, voters could see Libertarians as a more moderate choice. That’s how many Granite Staters felt when they voted for Libertarian presidential candidate Gary Johnson over Republican Donald Trump and Democrat Hillary Clinton.

Blackberry and painted turtle: Every year, the state’s fourth graders learn how the state government works, and every year, legislation gets filed on their behalf. This year, lawmakers saw a bill from students at Simonds School in Warner naming the blackberry the official state berry of the biennium. It made its way through the House and Senate, and Sununu signed the bill in June.

Another group of students from Main Dunstable School in Nashua wanted the painted turtle to be the official state reptile for the biennium. That bill was also signed by Sununu.

It’s an annual tradition at the State House and while some lawmakers believe it’s a waste of time, some say it’s a good opportunity to get students involved and interested in the political process.

Of course, no one will forget the time in 2015 when students in Hampton Falls proposed making the red-tailed hawk the state raptor and a lawmaker suggested the creature would be a better mascot for Planned Parenthood. That became a national news story.

Luckily, no incidents like that happened this year. And Sununu enjoyed snacking on some blackberries with the fourth-grade students when he signed the bill into law.

 

LOSERS:

Democrats: The New Hampshire Democratic Party struggled to find its footing this year. For the first time since 2010, Democrats were fully the minority party in the State House — Republicans had majorities in the House, Senate, Executive Council, and the corner office. The party couldn’t decide if it wanted to work with Republicans or be the party of resistance to their agenda.

Their lack of a mission or agenda was evident in the legislature. While Democrats banded together to help defeat right-to-work and the House’s budget, there were times when some members disagreed with party leadership and voted their conscience. When it became clear that it was very likely that a budget wouldn’t be passed in the House, some Democrats advocated for at least passing something on to the Senate.

While Democrats have long pushed full-day kindergarten, they didn’t like that the final bill tied its funding to the lottery game Keno. Most Democrats voted against it, and that could be a major policy issue when they face reelection next year.

But the question still remains: will Democrats work with Republicans in the next legislative session in January or will they resist? National politics will definitely influence their decisions, and it will also be an election year. More partisanship is likely.

 

Right-to-work: The bill called for prohibiting unions from charging fees to nonmembers for the costs of representation, but even in a GOP-controlled legislature, Republicans couldn’t get the votes. A lot of different factors went into its defeat in the House, including disagreements between Sununu and House Speaker Shawn Jasper, as well as some Republicans who are part of unions or know people in unions. This was a major bill that some lobbyists and advocacy groups pushed for, including the Koch-funded Americans for Prosperity-New Hampshire. Simply, the votes were not there and lawmakers voted to not bring up the issue again until at least 2019, but expect to see another bill if the GOP retains its majority in the legislature.

 

Transgender advocates: A controversial gender identity nondiscrimination bill was tabled in the House, much to the dismay of transgender advocates. The bill would have prohibited discrimination based on gender identity, extending gender identity the same protections under state law that exist for age, sex, sexual orientation, race, or creed. The protections would have applied to discrimination in housing, employment practices, and public accommodations.

House Speaker Shawn Jasper and other members of the GOP leadership sought to kill the bill, or at least get it off the agenda for the session. Their issue with the legislation mirrors the Republican opinion at a national level — the bill would have allowed transgender people to use the restrooms of their choice.

Advocates are hoping the bill could be resurrected next year.

 

Opioid crisis: The drug epidemic still has its grips on the Granite State, which is ranked as the second hardest hit state by per capita overdose deaths in the nation. Lawmakers passed some bills to help curb the crisis, but as with any legislative process, it can take a while for treatment and recovery centers to receive the necessary funds to make a difference.

The state is also now dealing with the rise of carfentanil, a synthetic opioid that is is so potent that it’s not intended for human consumption. It’s 100 times more potent than fentanyl and is commonly used to tranquilize elephants. There’s still a backlog at the state’s crime lab to investigate due to the increase in the number of drug overdose deaths.

While lawmakers seek political solutions for ending the crisis, advocacy groups say more creative solutions are needed, but it appears that the end of the epidemic is still not in sight.

House Speaker Shawn Jasper and House Freedom Caucus: The conservative caucus threatened to kill the state budget unless their priorities were included. None of its members were on the conference committee to have a say in final negotiations, but House Speaker Shawn Jasper reached out to members to market the budget as a conservative one. Ultimately, some House Freedom Caucus representatives voted for the budget due to its inclusion of anti-abortion language and business tax cuts. But, Jasper’s control over the speakership is still in question. With defeats of right-to-work and a House budget, some representatives are questioning his ability to lead. If the GOP retains control in the House, expect several people to challenge him in 2018 to be speaker.

NH Republicans Work Together to Pass State Budget, Full-Day Kindergarten

In two legislative victories for Gov. Chris Sununu, he saw Republicans unite to pass a state budget and full-day kindergarten. The New Hampshire House and Senate met Thursday for the final session of the legislative year in their respective chambers, and behind-the-scenes negotiations on the budget led to a win for the NH GOP platform. An $11.7 billion biennium budget is on its way to Sununu’s desk for his signature.

The scene was a joyous one for Sununu and Republican lawmakers in the Executive Council chambers at the State House after the budget vote. As Sununu walked into the room, cheering and applause broke out to celebrate their victory.

“Absolutely a big win, a big win for New Hampshire,” Sununu said after the vote. “People sent us to Concord to get a job done and we did it. And we did it the right way, we brought folks in and we listened and we talked, we kept working it the best we could and we came out with what I think is incredible progress for the state of New Hampshire.”

The Senate passed a committee of conference spending plan on a party-line vote of 14-9 in its Thursday morning session. About an hour later, the House passed the same budget on a roll call vote of 198-169. Only 14 Republicans voted in opposition and five Democrats supported the budget.

The margin of passage was wider than many people expected. Just a week ago, the fate of the budget in the House was uncertain, after conservatives tanked an earlier version of the budget in April. After some wheeling and dealing with Sununu and GOP Senate leadership, members of the conservative House Republican Alliance and House Freedom Caucus said while it was an imperfect budget, it was something that had some benefits for Granite Staters.

“Although the caucus as a whole is still concerned about the level of spending, there are definite benefits for the NH taxpayers,” the Freedom Caucus said in a statement. “The majority of our caucus members were able to support the budget in order to bring these benefits to our constituents.”

The business tax cuts added by the Senate were a significant factor in motivating the conservatives to vote in favor of the budget.

“There are many Republican leaders to thank for the passage of this bill — [House] Speaker [Shawn] Jasper, Senate President [Chuck] Morse, and Governor Sununu united the party in Concord and ensured passage of this Republican budget,” said NHGOP Chair Jeanie Forrester. “Republicans of all backgrounds and stripes united to pass this budget and ensure a stable and bright future for the State of New Hampshire. This shows that when Republicans are united, Republicans win and New Hampshire is better off for it.”

A companion bill that made the policy changes reflected in the budget also passed the Senate by a 14-9 margin and in the House by a vote of 212-161.

The companion bill included a phase-in of business tax cuts, elimination of the electricity consumption tax, and authorization of online lottery games. The budget will take effect on July 1, the first day of the new state fiscal year.

While Republicans claimed a win for their legislative agenda, New Hampshire Democratic Party Chairman Ray Buckley sent a fundraising email to supporters, blasting the GOP-backed spending plan.

“Gov. Sununu’s reckless and dangerous budget will take New Hampshire’s progress and turn it into disrepair,” Buckley said. “Republicans assume New Hampshire’s problems will just fix themselves. That’s not leadership, that’s ignorance. Let’s work together to make sure we have the state government we deserve in Concord.”

Later in the day, the House and Senate also passed another of Sununu’s policy priorities: funding for full-day kindergarten. The funding starts with state dollars, but after two years, it would be funded from revenue generated by newly authorized Keno.

Over the legislative session, Sununu stuck by his campaign promise to see full-day kindergarten come to fruition. He called for it in his budget, stood by his pledge after House Republicans stripped its funding from their budget, and then applauded once the Senate revitalized it as a standalone bill. He showed his flexibility when the policy and funding levels changed each time and while the final bill was not what he originally intended, he called it a “first-step.”

The House overwhelmingly passed Senate Bill 191 on a roll call of 251-111. The Senate vote was 15-8, with 12 Republicans and three Democrats in favor, and two Republicans and six Democrats opposed.

It was a difficult bill for some lawmakers to stomach tying online gambling revenue to education. For Sen. Lou D’Allesandro, D-Concord, he’s been a longtime advocate of casino-style gambling in the state, but he voted against the bill since he didn’t believe the two issues should be linked.

On the opposite end, Senate Majority Leader Jeb Bradley is not a big supporter of Keno, but he voted in favor of the bill to invest more in early education.

Still, the bill made it through the legislature and is headed to Sununu’s desk, who applauded its passage and declared that he is “the first governor” to deliver a full-day kindergarten.

“The investments made today will give New Hampshire’s children a strong foundation for tomorrow’s future,” he said. “I am proud to be the first governor to deliver a real full-day kindergarten program for communities across our state, which will close the opportunity gap and provide students, regardless of their economic status, an extra step up as they enter the first grade. Full-day kindergarten is good for children and families, and a critical tool in retaining our future workforce.”

Full-Day Kindergarten Makes It Out of Conference Committee. Drinking Water Bill Dies.

On the last day of conference committee work in the New Hampshire State House, a deal was reached to fund full-day kindergarten, but a bill aimed to improve water quality standards stalled in committee.

A last-minute deal was reached Thursday between GOP members of the House and Senate on using revenue from the lottery game Keno to fund the legislature’s plan for full-day kindergarten, but Democrats no longer support the bill. They say it doesn’t fully fund the program for all cities and towns and local communities are going to be left to pick up the bill. Exactly how much the state would spend per-pupil will depend on how much revenue is raised from taxing Keno.

The amendment presented by Sen. Jeb Bradley, R-Wolfeboro, guarantees school districts that want full-day kindergarten an extra $1,100 per kindergarten pupil. The state currently offers school districts an “adequacy grant” for half-day kindergarten of $1,800 per student, which is half of the $3,600 for students in grades 1-12. About 75 percent of the school districts in the state have already adopted full-day kindergarten using local property taxes to pay for it.

Democrats wanted the second half day of kindergarten to be fully funded at $1,800 per student in exchange for support on legalizing and regulating Keno. However, Republicans were cautious to do that out of concern that Keno would not generate enough revenue to support the full amount.

The amendment guarantees that at least $1,100 will go to funding full-day kindergarten since they are confident enough Keno revenue will be raised to do that. The state will fully fund the program at $1,800 if Keno revenues are enough. If not, the grants will be pro-rated per community at an amount between $1,100 and $1,800 depending on the exact amount that is raised from Keno.

Gov. Chris Sununu has made full-day kindergarten a priority for his first term in the Corner Office. While funding negotiations have constantly changed over the past few months in the State House, he applauded the deal lawmakers made and said it was a “first step” in getting the program fully funded.

“This is not a time for partisan politics, we need to get this done,” he said in a statement. “This is one of the most transformative pieces of legislation, and more progress for kindergarten than this state has ever seen.  As revenues increase, the amount of funding can increase for kids. It is not only a first step, it is a real plan that funds full-day kindergarten across every community in this state.”

But Democrats say this isn’t the deal they agreed on. Senate Democrats called it a “shell game.”

“Senate Democrats have been leading on Kindergarten for years, and we are glad Governor Sununu has at least attempted to follow our example. But, today’s failure to support full-day kindergarten like any other grade while giving even more tax cuts for the wealthy elite is a major disappointment and once again demonstrates Governor Sununu’s failure to lead,” said Senate Minority Leader Jeff Woodburn.

Democratic gubernatorial candidate Steve Marchand called the “kenogarten” policy “disingenuous.”

Former 2016 Democratic gubernatorial nominee Colin Van Ostern was active on Twitter to express his disappointment that the deal reached in the conference committee didn’t guarantee full funding of kindergarten at the $1,800 level.

The full-day kindergarten bill is expected to pass in the House and Senate next week.

A separate bill that would lead to stronger standards for a toxic chemical in more than 200 communities’ drinking water ultimately died in committee.

The bill would have required the Department of Environmental Services to set a standard for a group of chemicals known as perfluorochemicals or PFCs. The state currently uses the federal government recommendation of 70 parts per trillion, but other states have set tougher standards.

The conference committee couldn’t agree on the bill due to concerns that it could require towns to make expensive upgrades to their water systems. The defeat of the bill in the legislative session saw both Republicans and Democrats disappointed that it failed.

“I am very disappointed House Republicans rejected drinking water standards that protect the public health, particularly prenatal and early childhood health,” said Sen. Dan Feltes, D-Concord. “Just like on the budget, Republicans have caved to the know-it-all wealthy elite and big corporations at the expense of everyday Granite Staters – folks who just want clean drinking water for them and their children.”

According to recent research from the Environmental Working Group and Northeastern University, New Hampshire is tied with Alabama as having the second worst PFC contamination of drinking water in the country.

Sen. Dan Innis, R-New Castle — a sponsor of the bill — said it was a “common sense piece of legislation.”

“I am deeply disappointed that the House was unwilling to come to an agreement to better protect the citizens of my district and around the state from the growing concern about the quality of our drinking water,” he said. “This critical legislation will be the first bill that I file in the fall. It is imperative that we quickly come to an agreement to address this pressing issue for the Granite State.”

Democrats Fight Against Voting Reform, Fetal Homicide Bills Come Up Short in N.H. House

It wasn’t a good day for Democrats in the New Hampshire House. Lawmakers who were opposed to bills like election law reform and fetal homicide legislation saw that their efforts were futile in convincing a Republican-led chamber to defeat them.

Thursday marked the final deadline for the House to act on legislation that originated in the Senate before conference committees are set up on bills to reconcile any differences between the two chambers. Naturally, some of the most controversial bills were saved for this day and most of them passed the House despite protests and hard campaigning from Democrats.

The House passed Senate Bill 3, a bill tightening the identification requirements for people registering to vote, by a 191-162 vote. Only two Democrats voted for the bill and nine Republicans opposed it.

“I commend the support of the House in strengthening the residency requirements for voters in New Hampshire as there is nothing more sacred as a citizen of this state and this nation than the right to cast a ballot in a free and open election,” said bill sponsor Sen. Regina Birdsell, R-Hampstead. “This legislation does nothing more than ask a resident to provide proof that they live where they say they do and provides an additional layer of protections increasing the integrity of elections in the state of New Hampshire.”

This was one of the most hotly debated bills of the legislative session. Proponents say it closes a “domicile loophole” where people are allowed to vote in the state without being required to prove it. Opponents believe it’s a GOP bill to suppress voters, especially young people.

“Today’s vote in support of SB 3 was a partisan sabotage of the election process that will do nothing but confuse and intimidate new voters,” said House Minority Leader Steve Shurtleff. “This legislation adds over 350 words to the registration form that new voters will be required to read, and swear to understand, with the pressure of a growing line behind them at the polls on Election Day.”

The bill heads back to the Senate, which is expected to concur with small changes made by the House. If they approve of it, the bill will go to Gov. Chris Sununu’s desk where he is expected to sign it into law.

Democrats accused that the bill further perpetuates President Donald Trump’s claims that there is rampant voter fraud in the United States.

“This legislation was clearly designed to placate those who buy into President Trump’s discredited assertion that fraud cost him the popular vote in New Hampshire,” Shurtleff said. “Leaders from both parties denounced those assertions, and as we know from the reports released following every single New Hampshire election, voter fraud is not an issue in our state.”

SB 3 also has the backing of Secretary of State William Gardner, a Democrat. He said he doesn’t believe the bill places undue burdens on any voter. He was recently asked to sit on Trump’s voter fraud commission.

The bill also garnered interest from outside groups that spent money in the state to convince residents to contact their legislator to oppose the bill.

“As host of the first-in-the-nation primary, New Hampshire has the obligation to ensure our system is beyond reproach,” Sununu said in a statement. “This bill does exactly that and as such, I support SB 3 and commend the House of Representatives for their actions today.”

Democrats were also not happy about the passage of Senate Bill 66, legislation that defines a fetus at 20 weeks and beyond as a person for purposes of criminal prosecution of murder or other violent crimes.It contains an exemption for abortion. The bill passed 186-170.

Democrats tried several times during the session to table the bill, but those attempts failed. The bill was originally retained in the House Criminal Justice Committee a couple weeks again and lawmakers expected to work on it over the next few months. In a surprise move last week, Republicans reconsidered the bill and voted it ought to pass to the full House.

“Today, the House of Representatives passed a critical fix that allows prosecution of individuals who criminally end the life of a viable unborn baby,” Sununu said. “It provides security and addresses injustice for women who may have been in abusive situations that resulted in the death of a fetus.”

The bill will also go back to the Senate to concur on a House amendment and then on to Sununu’s desk, if approved.

There was a bright spot for Democrats when the House overwhelmingly passed Senate Bill 191 to fund full-day kindergarten in the state. The final vote was 231 to 100.

Approximately $1,100 per pupil would be sent to school districts for the program with the funds coming through revenues from Keno, the electronic bingo game, which is currently illegal in New Hampshire.

“The House of Representatives deserves high praise for moving full-day kindergarten forward and recognizing that this is a priority for many families in both considering the quality of a community’s public education and in their decision-making process when choosing a place to raise their children,” Sununu said.

The bill heads back to the Senate, which has historically rejected Keno. Democrats blasted the Senate budget for not funding full-day kindergarten in its proposal, but it’s not clear if tying Keno revenues to the program will deter it in the Senate.

“This bill is a long-overdue recognition of those benefits, and a signal to working families and the business community that we understand our obligation to offer all New Hampshire children the opportunity for a high quality education,” Shurtleff said. “Support of full day public kindergarten is a top priority for House Democrats, and I am pleased that the Republican majority has joined us in recognizing the benefit of this investment.”

House Approves Full-Day Kindergarten, Democrats Claim Legislative Victory

In a win for Gov. Chris Sununu’s agenda, the New Hampshire House gave a preliminary vote of approval for full-day kindergarten. While some are calling it a bipartisan victory, the state Democratic Party is taking credit for the proposal getting passed.

Senate Bill 191 calls for providing $14.5 million during the next two fiscal years to help communities that want to implement full-day kindergarten.

In Sununu’s budget proposal, he provided $9 million a year to establish programs in the neediest communities of the Granite State. That original funding amount passed the Senate at the end of March on a 21-2 vote.

The House Education Committee changed the funding to the full $14.5 million to allow all communities, regardless of need, the opportunity to implement the program. About three-quarters of New Hampshire’s communities currently have full-day kindergarten, but the state only pays half the per-student amount for children in kindergarten. The House approved that funding on Thursday on a 247-116 vote.

“I applaud the House for taking this important step today to provide financial support to communities that choose to support and create full-day kindergarten programs,” Sununu said in a statement. “I believe strongly that this is the right thing to do and I look forward to continuing to work with the legislature as the measure moves forward.”

The roll call vote saw 87 Republicans join 160 Democrats in supporting the bill. Many education advocates cheered the bipartisan work of the House and Senate for getting the bill passed.

“With today’s vote, strong bipartisan majorities in the House and the Senate are on record supporting increased state funding for full-day kindergarten,” said Mark Shriver, president of Save the Children Action Network. “We are encouraged that lawmakers from both parties have made investing kids in the Granite State a priority.”

The New Hampshire Democratic Party framed it another way. In their own press release, chairman Ray Buckley called Sununu’s original proposal of funding full-day kindergarten at $9 million a year a “half-baked plan.” He also highlighted that no Democrats opposed the bill and a majority of Republicans (115 of 202) voted against the legislation.

“Today, Democrats held him accountable for his broken promise by finally providing every child in the state full-day kindergarten instead of ceding to his half-baked budget proposal,” he said. “Democrats carried the bill across the finish line in the House, with every single Democratic House member voting for the legislation while a majority of Republican members voted against it. Sununu’s inability to lead almost cost us full-day kindergarten. Today was another example of why we need Democrats in the State House.”

House Republicans are pretty divided over whether the state should pay for full-day kindergarten.

On the House floor, Rep. Victoria Sullivan, R-Manchester, said she opposed the bill because it removes local control from the communities and removes parental choice.

“It was never intended that 5-year-olds would be sitting at a desk for six hours per day,” she said. “We must allow districts to keep decisions regarding early childhood education as a local control issue so that we can fix Kindergarten and restore it to its intended purpose, which is to foster the individual talents and abilities of each child through exploration, creativity and movement.”

Other Republicans say the bill doesn’t mandate that schools offer full-day kindergarten, but simply allows communities access to funds to help pay for it.

“If Kindergarten is important, why don’t we fund it for everyone?” said Rep. Terry Wolf, R-Bedford. “This bill helps offset the downshifting of costs from state to local communities. Funding education makes a statement that we value education and support our communities.”

SB 191 was one to watch on Thursday because House GOP leadership did not take an official position on the bill or whip any votes. House Speaker Shawn Jasper was presiding over the session, so he didn’t cast a vote, but House Majority Leader Dick Hinch voted in favor of the legislation.

Leaders of the two conservative House caucuses voted against the bill, showing there isn’t widespread support among those factions for full-day kindergarten. Rep. Laurie Sanborn, R-Bedford, who is a leader of the House Republican Alliance, and Rep. J.R. Hoell, R-Dunbarton, who is a leader of the House Freedom Caucus, opposed the bill.

SB 191 now heads to the House Finance Committee for representatives to look at the cost since the measure uses state revenues. In an earlier session, members of the committee refused to put any money for kindergarten in its version of the state budget.

After the committee makes a recommendation, the bill returns to the full House for another vote. If the House approves funding again at the $14.5 million-a-year level, then it will go to the Senate.

The Senate could then approve the bill at that funding level or the chamber could reject it in favor of their previous $9 million-a-year plan for targeted communities. If that happens, it’s likely a committee of conferences between the two chambers would be established to negotiate a compromise.

Regardless, the House’s approval of full-day kindergarten on Thursday is a good indication that a bill at some funding level will end up on Sununu’s desk, fulfilling one of his campaign promises.

One of Gov. Sununu’s Education Priorities Passed Favorably Out of Committee

In a victory for New Hampshire Gov. Chris Sununu, the House Education Committee voted favorably for a bill that would increase state funding for full-day kindergarten. However, a school choice bill was killed for the rest of year.

Sununu has called himself a “believer in school choice,” but had some reservations about Senate Bill 193, which would establish education freedom savings accounts for parents to use taxpayer funds and turn them into personal “scholarships” for students.

The measure would have allowed parents to use the approximately $3,500 that schools receive per student and put the money for tuition in private or religious schools, pay for the costs of homeschooling, or even for supplies to tutor their children. It’s similar to the typical voucher program in other states, but the New Hampshire bill allows parents to use the funds for multiple educational opportunities that they want for their child.

Opponents don’t want taxpayer funds to be diverted from public schools. They also say the program would unconstitutionally provide taxpayer dollars to religious schools. Supporters argue the bill gives parents more options for their students.

The House Education Committee sidetracked the bill Tuesday and voted 15-4 to retain it in committee to study further, essentially killing the bill until 2018.

“There are a lot of aspects to this bill which I think we really need to drill down,” said Rep. Rick Ladd, R-Haverhill, chairman of the committee.

The bill previously passed the Senate on a 14-9 vote in March.

Rep. Mary Heath, D-Manchester, said “this bill undermines public education.”

“Our New Hampshire Constitution is clear that public funds cannot be used for sectarian purposes,” she added. “We have failed to fund our public schools in the manner in which we should fund them. To move to this process would undermine what we have stood for.”

Sen. John Reagan, R-Deerfield, was the author of the bill, and he told reporters after the vote that retaining the bill was due to the result of special interest groups, specifically the unions, who blocked his legislation. He said it was a loss for the students of New Hampshire.

Yet, the bill had bipartisan support in its defeat with several Republican lawmakers saying they wanted to draft a better version of the bill that has a chance of passing in the Legislature.

Rep. Dan Wolf, R-Newbury, said retaining a bill in committee is equivalent to “death with dignity. So let’s hope that this is death with dignity.”

Despite supporting school choice, Sununu raised questions last week about how the legislation could impact public schools.

“I think when it comes to using state money for schools, and I think a lot of people know I’m a big believer in school choice, that whatever we do, we have to make sure we’re not harming public schools,” he told New Hampshire Public Radio. “We’re not just removing funds out of those schools and we understand that as we move money around, what those pros and cons might be. I do have concerns when you start using state funds, whether it be a voucher program, or all the different terms that you want to put for it, to schools of a non-public nature.”

 

FULL-DAY KINDERGARTEN PASSES

At the same committee hearing, on a 15-4 vote, representatives passed Senate Bill 191, which would increase funding for full-day kindergarten, a priority Sununu has pushed this legislative session.

Sununu made a rare appearance before the committee last week, urging the House committee to approve the Senate bill, which was modeled after his original proposal.

In his budget proposal, Sununu called for $9 million-a-year to be given out in grants to the communities with high levels of low-income students and English language learners that wanted to opt for full-day kindergarten programs instead of half-day. The Senate approved of that plan in March on a 21-2 vote.

The House Education Committee voted to amend the bill, recommending that the House fund full-day kindergarten for all communities, regardless of need, that wanted to expand their kindergarten programs. They also voted to increase the cost to approximately $14.5 million per year, which was the same amount that Sen. David Watters, D-Dover, proposed in the first draft of the bill in the Senate.

“Today’s actions are a significant step forward for New Hampshire,” Sununu said in a statement. “Full-day kindergarten is good for children, families, and a critical tool in retaining our workforce.”

The bill will be taken up by the full House next week. If passed, it would be sent to the House Finance Committee for review, before returning to the House for a final vote.

House Finance Committee Takes Ax to Gov. Sununu’s Budget Proposal

With about $59 million less to spend than expected, it’s natural that the House Finance Committee would trim a few items from Gov. Chris Sununu’s budget proposal. Yet, the cuts they’re making are concerning advocates who championed Sununu for including them in the first place.

On Wednesday, Republican budget writers in the House killed Sununu’s plan to spend $18 million over the biennium to expand full-day kindergarten programs. They also cut a $5 million college scholarship program.

“This is a short-sighted decision by a subcommittee of the Finance Committee,” said Mark Shriver, president of Save the Children Action Network, in a statement. “When he proposed his budget last month, Governor Sununu showed that he recognizes the importance of a full-day of kindergarten and understands the long-term economic benefits quality early learning programs can have for New Hampshire. The Republican majority in the House should stand with Governor Sununu and vote to put the full-day kindergarten funding request back into the budget.”

Full-day kindergarten isn’t the only proposal on the chopping block. The Alcohol Abuse Prevention and Treatment Fund was also cut this week.

The Alcohol Fund was created in 2000 by a bipartisan majority in the Legislature to be a funding mechanism that takes 5 percent of the gross profits from the sale of alcohol to support education, prevention, treatment, and recovery programs for alcohol and drugs. The funds would be allocated to the Governor’s Commission on Alcohol and Drug Abuse Prevention, Intervention, and Treatment to pay contracts for service providers in communities.

The fund has only been fully financed one time since its inception, which was in the 2003-2004 biennium. In his budget speech, Sununu proposed increasing the funds to 3.4 percent, double the 1.7 percent rate the previous budget had set.

“First, I propose we double the Alcohol Fund, increasing these important resources by more than $3 million and creating incentives to ensure that those funds are truly spent,” he said in his Thursday speech.

In several biennium budgets, the governor or Legislature would usually suspend the formula and allocate monies from the general fund to go to substance abuse prevention, treatment, and recovery.

Since there’s $59 million less in tax revenue coming in than expected when Sununu wrote his budget, Alcohol Fund advocates suspected that lawmakers would suspend the formula again. However, a more dramatic approach was taken by the House Finance Committee on Tuesday.

An amendment introduced by Rep. Neal Kurk, R-Weare, was added to the budget in House Bill 2 that would repeal the Alcohol Fund for good and it passed in a 6-4 vote on party lines.

“They’re trying to get to a number and they’re trying to come up with different avenues to do that, and some are very creative,” said Kate Frey, vice president of advocacy for New Futures, a nonprofit advocacy group that’s been one of the biggest proponents of the Alcohol Fund.

“New Futures has always been in favor of restoring the Alcohol Fund and using it as intended by the original statute to address problems for the substance abuse crisis,” she told NH Journal. “The fact that they are repealing the Alcohol Fund in its entirety is very unsettling.”

Advocates and some lawmakers like the fund because it’s non-lapsing and flexible, which is a creative and innovative solution to curb the opioid epidemic. The funds are non-restrictive, unlike some federal funds from grants that can’t be used to build brick-and-mortar recovery centers, for example.

New Hampshire is expected to receive $6 million, less than the $10 million previously anticipated by state officials, from the 21st Century Cures Act, bipartisan legislation approved by Congress and signed into law by former President Barack Obama in December, which gave $6.3 billion in funding to states hit hardest by the opioid crisis.

When Kurk introduced the amendment, advocates were also concerned because the language in the amendment appeared that he also repealed the authority of the Governor’s Commission to disperse the funds. The issue was cleared up on Wednesday, when that language was changed, giving the authority back to the Governor’s Commission to allocate funds, but still repealing the Alcohol Fund. The measure passed on a 5-4 vote on party lines, with Kurk absent.

Rep. Cindy Rosenwald, D-Nashua, who sits on the House Finance Committee, said the Governor’s Commission would receive $5.9 million in 2018 and $6.2 million in 2019 for alcohol and drug abuse education, prevention, treatment, and recovery, slightly less than what was allocated in the current biennium. If the elimination of the Alcohol Fund is passed, it would be up to the Legislature in each budget to allocate whatever they thought was an appropriate amount.

“Without the stability of that fund, it’s concerning to providers that are thinking about expanding their services here,” Rosenwald told NH Journal. “The flat funding for the next two years doesn’t expand access to treatment or recovery very much.”

When introducing the amendment in New Hampshire, Kurk said it was inappropriate for alcohol funds to go to the opioid crisis and that the issue the fund was originally created to solve, alcohol abuse, isn’t the main issue anymore — it’s opioids.

Advocates were quick to point out that the statute language when it was first written allowed funds to be used for alcohol and drug abuse programs. They also dismissed the idea that New Hampshire doesn’t have an alcohol problem anymore. According to a 2014 report, the Granite State’s per capita alcohol consumption is nearly twice the national average.

“I was very surprised at the elimination of the [Alcohol] Fund and I was surprised that they would suggest that somehow there is a disconnect between alcohol and our current opioid epidemic,” said Tym Rourke, chair of the Governor’s Commission, in an interview with NH Journal.

“The suggestion that New Hampshire only has an opioid problem is just false and somewhat disappointing that the Legislature would be picking one group of individuals who are suffering over another,” he added.

Previously, the Senate Finance Committee recommended passage of Senate Bill 196, which would put the Alcohol Fund at the 3.4 percent rate originally proposed by Sununu. The bill was laid on the table so lawmakers could go through the budget process before deciding on the fate of that bill.

Once the House Finance Committee signs off on the budget, it goes to the full House for a vote. The Senate will then get their turn to go line-by-line in the budget. At this point, Senate budget writers could have more money to play with since revenue estimates change throughout the year, so in theory, reinstating the Alcohol Fund and funding full-day kindergarten could see a new life. Advocates for those issues are hopeful the Senate would return them to the budget for Sununu to sign.

How Does Gov. Sununu’s Budget Encourage Young People to Stay in NH?

Time and time again, New Hampshire lawmakers are told that they should be concerned about the state’s aging population. What kind of workforce is going to replace baby boomers as they retire and how does this older population impact housing, health care, child care, and transportation costs?

A governor’s commitment of encouraging young people to stay or come back to the state is usually revealed in their budget proposal, and Gov. Chris Sununu’s recent speech provides some clues on how he plans to do that.

In his Tuesday presentation to members of the House and Senate Finance Committees, Sununu was asked to cite his priorities in his budget.

“With me, everything is about not what we do in two years, it’s what we do for five, 10, and 20 years down the road,” the governor said. “So, I’m really trying my best to bring a philosophy of true long-term planning and long-term thinking. It’s about kids. It’s about what’s happening with our students, what’s happening with our younger population, making sure we can create a foundation there that can be lasting.”

Granted, it’s nearly impossible for Sununu or the Legislature to impact natural population change. As baby boomers retire, the state’s working population, aged 20 to 64, will begin a steady decline, dropping 50,000 persons from 2010 to 2030, which would strain already tight labor supplies and restrain economic growth and vitality, according to research from the New Hampshire Center for Public Policy Studies (NHCPPS).

New Hampshire’s two-year policymaking process also doesn’t help lawmakers’ ability to anticipate and plan for long-term demographic change, but it’s something they should focus on, the Center argues in a 2016 demographic report.

Of course, how to attract young people also differs based on party beliefs. The Republican solution is usually to cut business taxes to make New Hampshire more competitive, with the understanding that more business growth will bring more jobs, which will bring more young people to the state. Democrats believe that New Hampshire needs a massive infrastructure investment, such as a commuter rail connecting Manchester and Nashua to Boston.

Steve Norton, executive director of NHCPPS, said it’s a constant battle of perspectives and there is always going to be some state investment to encourage young people to stay.

Besides making decisions on which projects to fund, Norton said it can be difficult for lawmakers to decide which age group to focus on. Should they look at keeping early 20-somethings in the state or the late-20s-early-30s group who might want to come back?

“We have always lost 20-somethings for reasons that are obvious,” he told NH Journal. “It’s not always the most exciting place or they want to move to an urban center like Boston or [Washington] D.C. When I think about this question of workforce development, it’s really that 30-something population that is coming here.”

Norton pointed to policies in Sununu’s budget that help “create a connection to New Hampshire,” which would encourage a young person to stay after graduating from college or to come back to settle down. He focused on Sununu’s creation of a scholarship program and full-day kindergarten proposal.

Sununu proposed a new $5 million-a-year scholarship fund to assist high school students to attend colleges, universities, or workforce training programs in the Granite State. He said the Governor’s Scholarship Fund would be administered by a proposed commission and would be based partially on need to serve “at least 1,000 students each year.”

He is also seeking $9 million a year to fund full-day kindergarten. He said the funds, which would be awarded in addition to education adequacy grants, would target communities that need it most. It’s expected that he will receive some pushback from Republicans on this policy proposal, so expect the amount of funding to change in subsequent versions of the budget.

“Both of those policies have an impact on young people and there’s an increasing likelihood that they would come back or stay,” Norton said. “Sununu’s expansion of kindergarten could be an important distinction for people who want to start a family, since we know decisions that many people make are based on the strength of the local school systems.”

It can be argued that Sununu isn’t investing enough in higher education, since he didn’t propose increasing the state’s community college or university system’s budget. Without an increase in funding, it’s highly likely they will increase tuition for the next academic school year. The University System of New Hampshire is one of the most expensive public universities in the country and graduating students have some of the highest student loan debt in the nation. With high debt, young people might take more lucrative jobs in urban centers or in other states.

Norton said organizations and businesses that support workforce development and incentivize young people with benefits, such as loan forgiveness programs, could pave the way for a younger and stronger New Hampshire economy.

Kate Luczko, president and CEO of Stay Work Play New Hampshire — a nonprofit group focused on retaining young people in the state — echoed Norton’s sentiments, saying her organization partners with businesses to make their opportunities better known to high school and college students.

“I’m trying to get this message across that being a townie is cool,” she told NH Journal. “Somehow, kids feel like if they want to be seen as successful that means leaving New Hampshire, and there is this stigma of not being cool if you stick around.”

Norton said even the symbolism of having a young governor could benefit New Hampshire’s demographic trajectory. Sununu, at the age of 42, is currently the youngest governor in the United States.

“Symbolically, we also have a young governor who is focusing on economic development,” he said.

In his inauguration speech, Sununu said he was committed to reaching out to “100 companies in 100 days out-of-state to invite them in. You will not get all 100, but we will try. You can’t catch any fish if you don’t go fishing.”

“Even if none of that comes to fruition, you’re creating the symbolism that New Hampshire is a business-friendly and family-friendly place,” Norton said. “But as always, the devil is in the details. For many of the proposals he put forward, we’re going to have to wait and see how the legislative process defines them. There are a lot of potential impacts but we’ll have to wait and see what happens.”

The governor’s budget proposal is expected to go through many rewrites and changes in the next few months as it moves through the House and Senate. While he helps set policy, it’s up to the Legislature to decide what proposals will be funded.

There are a number of education, health care, and child care bills in front of the Legislature, but Norton said he’s not seeing legislation focusing on how to tackle the state’s demographic struggles. He is optimistic, though, since Rep. Neal Kurk, R-Weare, introduced a bill creating a demographic study committee, who would make recommendations to lawmakers about how to tackle the aging problem in the state. It recently passed in the House and now it goes to the Senate.

Luczko said is also hopeful that communication between businesses, lawmakers, advocacy groups, and policy experts will improve as they work together on their mission of attracting young people.

“I cringe when we see duplication of efforts and someone starts a new effort that’s already being done,” she said. “There is a fine line between ‘the more the merrier,’ but then there’s something to say about being more effective if we combine resources and are more strategic about it.”

The Four Education Issues Gov. Sununu Plans to Fund in His New Budget

Gov. Chris Sununu is quickly making education reform a priority during his two-year term. Just take a look at his Thursday budget speech.

“This budget and this administration recognizes local control in public education as the touchstone of policymaking, and that state government’s role in shaping education policy should be focused strictly on benefitting students and their families,” he said. “A major goal of this budget is to expand educational opportunity and choice for kids and their families.”

In his 2018-2019 biennium budget, Sununu focused on four areas of education reform that he wants to accomplish: full-day kindergarten, charter schools, higher education, and school building aid.

 

FULL-DAY KINDERGARTEN

Sununu’s proposal includes $9 million a year for full-day kindergarten. He said the funds, which would be awarded in addition to education adequacy grants, would target communities that need it most.

After his speech, Democrats sought clarity on how it would be determined which communities received funding.

“We also do not know from his presentation which communities will get full-day kindergarten and which ones won’t…” said New Hampshire Democratic Party Chairman Ray Buckley in a statement.

Sununu said the formula would be based on a community’s property wealth, the number of students on subsidized lunch programs, and the number of English as a second language students.

“So I am proud today to be the first governor to deliver a real full-day kindergarten program for communities across the state,” he said.

Some Democrats, including gubernatorial nominee Colin van Ostern, were in favor of requiring all school districts to offer full-day kindergarten. Sununu’s budget leaves the decision up to individual cities and towns, but if they opt for full-day kindergarten, they’ll receive more funds.

Regardless if a school district offers half-day or full-day kindergarten, they only receive 50 percent of the state’s per-pupil grant compared to students in other grades. Sununu’s proposal would give the neediest communities an opportunity for additional funds to make full-day kindergarten a possibility.

 

CHARTER SCHOOLS

In his speech, Sununu called for increasing charter school funding by $15 million.

“And in addition to fully funding the adequacy formula, funding for charter school is stabilized and enhanced in this budget by linking funding to the state’s average per-pupil expenditure,” he said. “This will increase funding for our charter schools by $15 million, helping eliminate uncertainty and volatility for administrators, teachers and parents.”

This is probably one of the more contentious proposals in his budget, and it will be interesting to see if that amount changes as it moves through the budget process in the Legislature.

All of New Hampshire’s 25 charter schools, except for one, rely mostly on state and federal funding, and all but one are not supported by local property taxes. In the Granite State, per-pupil expenditures for charter schools are about $6,500, which is lower than traditional public schools, which averages about $14,900 for the 2015-2016 academic year.

Sununu is a fervent school choice advocate and he’s hoping the Legislature passes charter school-friendly bills during the legislative session. Democrats claim charter schools take away state money that could go to improve traditional public schools, and they lack equal proportions of disabled or special needs students, who are then forced into the traditional public school system.

Senate Majority Leader Jeff Woodburn told NH1 News that diverting public school funding to charter schools “is the wrong direction. It doesn’t make our state stronger or our kids better.”

 

HIGHER EDUCATION

It’s often a criticism of the Granite State that the population is aging and young people are leaving . The million dollar question is how does the state plan on encouraging them to stay?

Higher education advocates see increased funding to the state’s community college and university system as a key investment into the future workforce of New Hampshire.

Sununu said he agrees, but university officials and higher education activists remain skeptical.

“Our higher ed system is a critical part of ensuring New Hampshire students have an opportunity to learn beyond their high school years and enter the New Hampshire workforce with real-world skills,” Sununu said in his speech. “My budget approaches post-secondary education strictly in terms of students and outcomes. The university and community college system of New Hampshire are key to these efforts, and we’ll continue to make investments in our partnership.”

He proposes a “significant increase” to the operating budget of the community college system, to the tune of $10 million for capital infrastructure investments.

However, it’s not immediately clear where those funds are coming from. A few months ago, New Hampshire’s Community College system asked lawmakers for about $49 million for 2018 and $52.5 million for 2019, an increase from about $44 million in the current budget.

In Sununu’s budget, it appears that the community college system’s proposed budget is the same amount of funding as in the current budget. He could pull the funds from infrastructure funds, but it wasn’t exactly clear where he would do that.

University System of New Hampshire (USNH) officials were not thrilled that they didn’t see an increase in their budget either. Sununu’s proposal would provide $81 million a year to the university system — the same level as the current budget. USNH asked for $88.5 million in 2018 and $93.5 million in 2019.

Without an increase in funding, it’s likely tuition will once again increase for the next academic school year at USNH colleges by no more than 2.5 percent for in-state students. The actual figure will be known later this spring after trustees set the rate.

In a statement, USNH “expressed deep disappointment” that the governor’s budget did not provide additional funding, which would have allowed the system to freeze or lower tuition for in-state students.

“Keeping our public, four-year colleges and universities affordable is not only critical for hard-working New Hampshire families, but also for the many businesses that depend on highly skilled talent to grow, thrive and succeed,” USNH Chancellor Todd Leach said in a statement.

Full time in-state tuition at UNH is $14,410 for the 2016-17 academic year. Room and board varies depending on the type of housing and meal plan, but costs range between $10,000 to $14,000 a year.

USNH receives the lowest state funding per capita of any university system in the county and tuition costs for New Hampshire students are some of the highest in the nation, which leads to students also having some of the highest student loan debt in the country after graduation.

Rep. Wayne Burton, D-Durham, and a former college administrator, criticized Sununu’s “cold shouldering of USNH.

“I’m deeply disappointed that Gov. Sununu, though professing the need for an educated workforce, shortchanged the principle player in that effort, our state university system,” Burton told the Fosters Daily Democrat.

Instead of increasing funds to the university system, Sununu proposed a new $5 million-a-year scholarship fund to assist high school students to attend colleges, universities or workforce training programs in the Granite State.

“We have to understand that not every student travels the same workforce path, and we need to build a system that provides flexibility to work within their lifestyle,” he said. “This scholarship program is designed, not to help 10, or 20, or even a 100 students, but at least 1,000 students each year, and we’ll open workforce gateways like never before.”

He said the Governor’s Scholarship Fund would be administered by a proposed commission and would be based, partially, on need.

 

SCHOOL BUILDING AID

The state is expected to end the current two-year budget with an $80 million surplus, and most of that money will be going to one-time expenses to fix roads and bridges, and provide school building aid through the “Infrastructure Revitalization Fund.”

“For the first time in a long time we’re going to give a boost to school building aid by granting dollars directly to communities to rebuild our classroom infrastructure,” Sununu said. “Specifically, schools with health and safety issues in towns that might not be able to otherwise address things like asbestos, lead paint, or other critical safety issues and these are where our school building aid will be targeted and funded.”

It’s unclear exactly how much of the $80 million surplus would be available at the end of the current fiscal year, and how it would it be allocated to cities and towns, but Republicans applauded the proposal during the governor’s speech.

Two Major Issues Democrats Have With Gov. Sununu’s Budget

After Gov. Chris Sununu released his $12.1 billion biennium budget on Thursday, the overall sentiment among Democrats and Republicans was “the devil is in the details.”

Those details will be hammered out in the next few months as the House and Senate make their recommendations to Sununu’s 2018-2019 budget. Overall it appears both parties believe it’s a solid budget with room for improvement. Republicans praised it for being “a realistic, conservative budget which is transparent, forward thinking and strengthens education, supports our cities and towns and focuses on solving real problems that have plagued taxpayers for years,” according to Senate leadership.

Democrats were glad that Sununu kept some of his campaign promises, but were also critical that he didn’t provide too many details on proposals they deemed important, including Medicaid expansion and full-day kindergarten.

“I am very concerned about the $500 million cut from state agency budget requests and what that could mean to the citizens of New Hampshire,” House Minority Leader Steve Shurtleff said in a statement. “The governor’s budget address made no mention of the successful NH Health Protection Program, leaving serious unanswered questions for the 50,000 Granite Staters who rely on the program for their health care coverage.”

In his budget proposal, Sununu includes more than $50 million in spending to address an existing shortfall in the Department of Health and Human Services’ (DHHS) fiscal 2017 budget.

In January, DHHS projected a $65.9 million dollar budget shortfall. Commissioner Jeffrey Meyers pushed back against the accusation his department overspent, claiming instead Medicaid costs did not decline as the legislature expected during the last budget debate. That put Sununu in the awkward position of writing a budget with an unexpected hole in it, while also figuring out how to handle Medicaid for the state.

As for the deficit, Sununu is requiring the commissioner to make quarterly reports to him and members of the legislature leadership “about where we actually stand on our true costs, so we can become a more nimble government that’s responsive, not just reactive.”

“As governor, I won’t make people wait until after an election to discover we may have a shortfall,” he said in remarks during a Thursday joint legislative session. “We have to be transparent. We have to be honest with the people and honest with ourselves.”

Democrats’ claim he didn’t mention Medicaid expansion is true. He only mentioned the program when talking about the DHHS deficit, since that’s where the department says its money went.

“And where we have failed in the past, I am pushing for true accounting of our Medicaid program so we can reconcile estimated Medicaid payments to actual costs,” Sununu said. “And as we go forward, be sure that we won’t wait two years to check in on them again.”

He doesn’t say if he plans to expand, repeal, or replace NH Health Protection Program. The Medicaid program in New Hampshire received bipartisan support in the legislature last year when lawmakers extended the program until Dec. 31, 2018.

That legislation gives Sununu wiggle room as he attempts to balance politics and health coverage for the state. As Washington debates repealing the Affordable Care Act, several states including New Hampshire are waiting to see how Congress and President Donald Trump’s administration handles the issue.

Sununu was reluctant to say anything about Medicaid on the campaign trail, commenting he was worried about financing the program in the long-term, but didn’t mention repeal. Not wanting to permanently fund the program, he told voters it was better to let the federal government make the first move.

Before the budget speech, Democrats waited to see if Sununu would fulfill his campaign promise of funding full-day kindergarten. His proposal includes $9 million a year for full-day kindergarten, but after the speech Democrats sought clarity on determining which communities get funding.

Sununu said funds, which will be awarded in addition to education adequacy grants, would target the communities that need it most based on a community’s property wealth, the number of students on subsidized lunch programs, and communities with a high number of English as a second language students.

“So I am proud today to be the first governor to deliver a real full-day kindergarten program for communities across the state,” he added.

There’s a big distinction to be made with the state “mandating” full-day kindergarten and simply funding full-day kindergarten. Several Democrats sought to require school districts to offer full-day kindergarten, but Sununu’s budget doesn’t make that a requirement. He’s leaving it up to the individual cities and towns, but they’ll receive more funds if they opt-in.

In towns that vote to implement full-day kindergarten, school districts presently only receive 50 percent of the state’s per-pupil grant for kindergarten students. Under Sununu’s plan, the neediest communities can apply for additional grants to make the program possible.

Rep. Victoria Sullivan, R-Manchester, who sits on the House Education Committee, said she wasn’t thrilled about Sununu’s full-day kindergarten funding proposal. Sullivan said it should be a local community’s decision, and could eventually lead to mandated full-day kindergarten.

House Speaker Shawn Jasper told reporters Sununu’s full-day kindergarten proposal probably won’t be included in the House version of the budget.

“I think that is going to be a stretch,” he said. “I think if you looked around the hall, you probably didn’t see a lot of enthusiasm on the part of Republicans on that issue. We’ll have different priorities in some areas than the governor has, certainly. I don’t think there’s ever been a budget that’s gone into the House and come out looking the same way, but he’s given us a great starting point.”

The two-year budget must be passed by June 30 to go into effect on July 1 of the next fiscal year. The House Finance Committee will look at Sununu’s budget before making a recommendation to the full House. After the House passes its version of a budget, it goes to the Senate Finance Committee, which will recommend its own proposals to the full Senate, before going to the governor’s desk for his signature or veto in spring.
