State Rep. Dylan Germana is a young Democrat on the move.

Unfortunately, that includes moving out of his district.

The New Hampshire Attorney General’s Office announced Friday there is “credible evidence” the Keene Democrat falsely claimed residence at his father’s home in the college town when he was actually living in Dover.

Later that day, Germana resigned from his House seat.

NHJournal first reported questions raised about Germana’s residency and the legislator’s refusal to answer the question, “Where do you live?” He served in both the state House and on the local school board.

NHJournal also asked Germana’s father, state Rep. Nick Germana, who claimed as recently as Dec. 29 — apparently falsely — that his son lived with him.

“This is his residence,” Nicholas Germana told NHJournal.

Now the Attorney General’s Office is involved.

“I am writing to inform you that there is credible information that Rep. D. Germana may no longer reside within a municipality in his legislative district. Specifically, this Office obtained information indicating that Rep. D. Germana may be residing in an apartment in Dover, N.H.,” Assistant Attorney General Matthew Broadhead wrote in a letter sent to House Speaker Sherman Packard on Thursday.

Neither Dylan Germana nor his father responded to NHJournal’s requests for comment about the letter.

It is unclear when Dylan Germana moved out of Keene, but he has not provided any public indication of a pending move. He sat in on a House Municipal and County Government Committee hearing on Tuesday, but was absent on Friday. He has also taken part in Keene School Board meetings this month. As recently as Jan. 20, Dylan Germana participated in nonpublic negotiations for school district employees, according to meeting minutes.

Keene School Board Vice Chair Raleigh Ormerod told NHJournal he was unaware that Dylan Germana did not live in Keene, though Ormerod was reluctant to answer questions.

“You need to have residency in Keene to run for the school board,” Ormerod said. “I’ve told you everything I know.”

Before representing Keene in the state House and on the school board, Dylan Germana lived in Bedford. Nicholas Germana claimed in December that his son returned home before seeking elected office in 2024.

“He moved back here long before he ran for office,” Nicholas Germana said.

Now the younger Germana is out of office.

The news did not come as a surprise to House GOP leadership. House Majority Leader Jason Osborne (R-Auburn) used his Committee to Elect House Republicans to file an election law complaint last month alleging Germana moved out of Keene in June.

“It is imperative to determine how long Dylan Germana’s actions were known and seemingly tolerated within the Democrats’ ranks,” Osborne said in a statement at the time. “This situation reveals a possible conspiracy that goes beyond a single individual, suggesting a systemic issue that must be addressed to restore public confidence in our state’s governance.”

The attorney general’s investigation is ongoing and could spell further trouble for Dylan Germana and his father. In 2024, Republican Troy Merner pleaded guilty to one count of wrongful voting and one count of theft by deception after it was learned he moved out of his Lancaster district before he was elected in November 2022.

Merner faced charges, in part, because he filed inflated mileage reimbursement claims using his Lancaster district to calculate the distance to the State House in Concord. He began living in Carroll months before the 2022 election.

Merner avoided jail time under a plea agreement but lost his right to vote as part of the negotiated sentence.
